To ask the Secretary of State for Transport, whether National Highways has referred, or intends to refer, the dispute over defects identified at the M49 Severnside junction 1 to adjudication under the dispute resolution provisions of its construction contract.
To ask the Secretary of State for Transport, whether National Highways has referred, or intends to refer, the dispute over defects identified at the M49 Severnside junction 1 to adjudication under the dispute resolution provisions of its construction contract.
National Highways is continuing to engage with the principal contractor to seek an amicable and timely resolution to the issues identified at M49 Severnside Junction 1. As these discussions continue, no decision has been made on whether to pursue adjudication, and any future consideration of legal options would be subject to legal privilege.
The contract for M49 Severnside Junction 1 was awarded through National Highways’ Collaborative Delivery Framework as a design and build arrangement, with responsibility for the design resting with the appointed contractor. The framework is based on the NEC model, under which the contract value may vary in certain circumstances. However, National Highways is unable to disclose commercially sensitive information, including the original contract value, final sum paid, or any sums sought from the contractor, while ‘without prejudice’ discussions remain ongoing with the contractor, as doing so could compromise those discussions.
Design and build contracts include standard provisions requiring contractors to remedy defects during the defect correction period. Where issues are pursued outside that period, as in this case, any claim would be treated as a standard breach of contract claim. National Highways will continue to engage with the contractor to ensure a shared understanding of the technical information and identify responsibility and liability, determining whether the matter can be resolved amicably and expeditiously.
To ask the Secretary of State for Transport, whether the contract awarded by National Highways for the construction of the M49 junction 1 at Severnside was let as a design and build contract or as a construction only contract; and whether responsibility for the design of that junction rested with...

To ask the Secretary of State for Transport, what provisions the contract for the M49 junction 1 at Severnside contained requiring the contractor to remedy defects at its own cost; and whether National Highways has sought to recover any sums from the contractor in respect of that junction.

Just off the M49 in Severnside is a junction that has never carried a single vehicle. It was built six years ago and cost the taxpayer £40 million, but in those six years not a car, van or lorry has used it. The national press has dubbed it the “ghost...

I thank the Minister for giving way. I would just like to clarify one point. He said that it would have been appropriate for me to be notified earlier. Probably more importantly, it would have been helpful for South Gloucestershire council, which is proceeding with the work, to have been...

I am grateful for the intervention, and I absolutely will take that point. All stakeholders ought to be informed at the appropriate point, particularly when there are, as I say, connected works to do with that particular junction.

That this House notes with concern that nearly seven years ago National Highways constructed a junction with no slip road on the M49 near Severnside, since dubbed the Ghost Junction by the press; further notes that South Gloucestershire Council secured £7 million from the Department for Transport to connect the junction and is on track to complete the works by the end of 2026; is concerned that National Highways has now told stakeholders that the junction is not safe for use, has given no timeframe for a remedy and does not expect to provide further information until the autumn; observes that, in the meantime, heavy goods vehicles continue to travel through local villages and hamlets, causing significant damage to local roads; deplores that a public body was permitted to build a junction without a slip road and leave the council to complete the work; also notes that no body other than the Government is able to hold National Highways to account; is further concerned at the risk to the public purse arising from the proposed mitigation works, including the possibility that subcontractors become insolvent before completion; and calls on the Government to conduct a review of the situation and to hold National Highways to account.

The lorries thundering through must be deeply frustrating for the hon. Lady’s constituents, and they must be frustrated at not having the road network they thought they would get. It is an ideal topic either for an Adjournment debate or a Westminster Hall debate, so that she can hear from...

I will be as brief as I can, and well under the eight minutes, I think, Madam Deputy Speaker.
