I have not met with Mermaids in my time as a Minister in the Department. Ministerial meetings with external organisations are routinely published on GOV.uk.
Information on how many times officials have met with representatives from Mermaids could only be obtained at a disproportionate cost.

Protecting people and adhering to safeguarding responsibilities should be a governance priority for all charities. It is a fundamental part of operating as a charity for the public benefit.
Following concerns raised about Mermaids’ approach to safeguarding young people, the Charity Commission has opened a regulatory compliance case into the charity and has contacted its trustees. The opening of a compliance case is not itself a finding of wrongdoing.
As an independent regulator, the Charity Commission carries out its functions independent of ministerial or government control. It would therefore not be appropriate to comment further whilst the Charity Commission's investigation is ongoing.

Schools have flexibility over how they deliver the Curriculum and what resources they use.
The non-statutory implementation guidance, ‘Plan your Relationships, Sex and Health Curriculum,’ sets out clear guidance for schools in choosing resources, and states that schools should assess all resources carefully to ensure they are age appropriate, meet the outcome of the relevant part of the curriculum, and are in line with the school’s legal duties in relation to impartiality.
Schools should not promote contested theory as fact. The Department expects schools to use the Relationships, Sex and Health Education Curriculum to help children understand the world around them in an age-appropriate, balanced manner. The Department also expects schools to consult with parents on these matters and to make reasonable decisions about the content of their Curriculum.
The Department recognises the issues relating to gender identity, and we are currently developing transgender guidance to support schools to navigate these complex and sensitive issues. The Department intends to hold a full public consultation on the draft guidance prior to publication in 2023.
Over the past week, serious safeguarding failures by the children’s charity Mermaids have come to light, with revelations that the charity sent breast-flattening devices to young girls behind their parents’ backs, promoted harmful medical and surgical procedures to children and hired a trustee with links to paedophile organisations and a digital engagement manager who posted pornographic images online, including of himself dressed as a schoolgirl. For years, despite whistleblowers’ raising the alarm, Mermaids has had unfettered access to vulnerable children. Does my right hon. Friend agree that it has taken far too long for these concerns to be taken seriously, and does she also agree that it is high time there was a police investigation into the activities of Mermaids and its staff?

The Department grants team can confirm there is no record of a grant payment being made to Mermaids UK in the year 2019/20 to date or during 2018/19.

The Government Equalities Office has not provided direct funding to Mermaids. Mermaids were allocated funding through the LGBT Consortium on the Anti-homophobic, biphobic and transphobic bullying programme 2016-2019 and this funding ceased at the end of the programme in March 2019. A separate extension to this programme was retendered from January 2019 to March 2020 and Mermaids did not receive any funding through this process.

In England and Wales, an organisation is a charity if it meets a number of legal tests; namely that it is established for exclusively charitable purposes for the public benefit and that it falls within the jurisdiction of the High Court regarding charities. The charitable status of an organisation is a matter of law and the Charity Commission cannot remove the charitable status of a charity if it meets the legal test. There are no plans to review the charitable status of Mermaids UK.

A) Since becoming the Minister for Women and Equalities in April this year, The Minister has had one introductory meeting with Stonewall to discuss LGBT policy, and one meeting with The Founder of a Women’s Place.
B) Since beginning its consultation engagement work in September 2017, the Gender Recognition Act (GRA) consultation team have met with the named organisations on the following number of occasions:
i. Mermaids: once
ii. Stonewall: four times
iii. Gendered Intelligence (GI): three times
iv. Transgender Trend: twice
v. Fair Play For Women (FPFW): twice
vi. A Woman’s Place (WP): three times
During the GRA consultation, officials in the Government Equalities Office also held roundtables with various groups, including: one on the topic of prisons and offender management, which was attended by FPFW; one with women’s organisations and charities, which was attended by FPFW and WP; one with LGBT organisations, which was attended by Stonewall, GI and Mermaids; and one focused on Wales, which was attended by Stonewall Cymru.

Ministers for the Government Equalities Office regularly meet with a wide range of organisations with an interest in equalities. In the past three years this has included organisations like Stonewall and A Woman’s Place UK.
Government Equalities Office officials have met over one hundred organisations in the run up to, and during, the publication of the Gender Recognition Act consultation. This includes Mermaids, Stonewall, Gendered Intelligence, A Woman's Place UK, Transgender Trend and Fair Play for Women. Officials have also met other women’s and LGBT groups, refuges and domestic abuse charities, unions, service providers, government departments and other European Governments.
