To ask the Secretary of State for Justice, what recent assessment his Department has made of the number of Civil and Family Court cases where decisions were taken on the basis of manipulated forensic testing provided by (a) Randox and (b) Trimega.
To ask the Secretary of State for Justice, what recent assessment his Department has made of the number of Civil and Family Court cases where decisions were taken on the basis of manipulated forensic testing provided by (a) Randox and (b) Trimega.
Greater Manchester Police are undertaking an ongoing, expansive criminal investigation into alleged manipulation of toxicology results by individuals who were employed at Trimega, and later Randox Testing Services (RTS) after Trimega’s liquidation in 2014.
The investigation will seek to determine how many cases may have been affected and retesting of samples continues at pace. As such, it is not possible to provide an estimate of the number of cases affected at this time.
A bespoke court process has been implemented so that individuals who are concerned about the outcome of cases involving tests performed by Trimega can apply to the court to consider setting aside or changing their order.

The Department for Education (DfE) wrote to all local authorities on 17 November 2017, informing them that a process for asking the court to vary or discharge an order would be established for individuals who believed that the outcome of their case was materially affected by a potentially unreliable test. In further correspondence of 17 February 2018, the DfE gave local authorities further information about how to access the C650 court process online and how to support individuals that may approach them for help in this matter.
The information on whether any local authorities have written to any such individuals is not held centrally.

The department does not have information on whether the local authorities that commissioned forensic tests from Trimega, between January 2010 and April 2014, have carried out a case by case assessment of the effect of toxicology on decision-making in relation to the welfare of children. However, the department wrote to local authorities on 17 November 2017 and 16 February 2018, asking them to review whether they had commissioned forensic tests from Trimega Laboratories Limited between January 2010 to April 2014, and to consider whether there was a need to take further action in order to fulfil their safeguarding responsibilities.

Individuals concerned about the potential impact of an unreliable test result in their case can make an application to the family court to change, or set aside, the final order made in their case. The Government has established a bespoke process to do so through form C650 and has waived the court fee for all applications made using this process. This was announced by the Minister for Policing in a written Ministerial statement on 21 November 2017 (HCWS265). My department then wrote to the Justice Select Committee and a number of key stakeholders to draw their attention to this process including the Law Society, the Bar Council and the Association of Lawyers for Children. Of these, one was dismissed on application because it did not relate to testing undertaken by Trimega. Of the other three, one was withdrawn and another dismissed by the judge hearing the case. In one instance, a previous order was discharged.

The department wrote to all local authorities in England asking them to review whether they had commissioned forensic tests from Trimega Laboratories Limited between January 2010 and April 2014. 131 local authorities have confirmed that they used the services of Trimega Laboratories Limited during this period.
It is unlikely that decisions about the welfare of children will have been taken solely on the basis of toxicology test results, as this would only form part of the evidence that local authorities consider when making decisions about vulnerable children. The department does not have oversight of individual decisions made in local authority areas but have asked local authorities to consider whether any additional action is necessary in order to fulfil their safeguarding responsibilities.

The Pipeline Monitoring System was a non-contractual framework management process adopted under the National Forensic Framework Agreement (NFFA) and the National Forensic Framework Next Generation (NFFNG). Trimega worked in the family law sector and were not on the NFFA or the NFFNG.

On 19 January 2017, Home Office officials were made aware that malpractice may have occurred at Trimega. The available information regarding alleged malpractice at Trimega at this time was extremely limited. However, any potential impact was assessed to be outside the criminal justice system. When further information emerged in March 2017, Home Office officials informed Ministry of Justice officials, who then briefed their Ministers.

There have been two National Forensics Frameworks. One let in July 2008 by the National Policing Improvement Agency, known as the National Forensic Framework Agreement (NFFA), which ran between July 2008 and July 2012; and a replacement Framework let by the Home Office known as the National Forensic Framework Next Generation (NFFNG), which ran between 31 July 2012 and 30th July 2016. Both Frameworks were open to all police forces in England and Wales for the procurement of forensic analysis services. Randox Testing Services (RTS) were one of the forensic service providers on both frameworks. Police forces undertake the purchase of forensic analysis services themselves and may hold information on purchases with RTS.
Trimega were not party to either Framework. We can find no record of Trimega applying for either the NFFA or the NFFNG. I understand that Trimega worked in the family law sector rather than the criminal justice sector.

There is no centrally held information on possible commissioning by government departments from Randox Testing Services (RTS). The commissioning of forensic tests is an operational matter for local authorities.
The Department for Education has informed all local authorities of the police investigation and asked them to take action to ensure that their safeguarding responsibilities are met. All police contracts with RTS have been suspended pending the ongoing investigation.
Trimega went into liquidation in 2014 and ceased trading.
