The Government does not make individual assessments of companies' compliance with employment law. The Supreme Court's 2021 ruling on Uber drivers established that many drivers should be classified as workers with corresponding rights under UK employment law. Enforcement of employment law is undertaken by appropriate regulatory bodies including HMRC for National Minimum Wage, the Employment Agency Standards Inspectorate, and ultimately the employment tribunal system.
Any worker who believes their rights have been breached can seek redress through an employment tribunal, which determines compliance on a case-by-case basis.

The Department is considering options to improve the current regulatory position in respect of taxis and private hire vehicles and will consult shortly on whether to make all local transport authorities, including Strategic Authorities, responsible for taxi and private hire vehicle licensing.
We believe administering taxi and private hire vehicle licensing across a larger footprint would increase the consistency of standards and enable more effective use of enforcement powers across a whole functional economic area and facilitate integrated local transport planning. Greater economies of scale should also increase the efficiency in taxi and private hire vehicle licensing and the sector. This should reduce the factors that induce people to license out of their usual working area. This would be a significant change for the sector, and responses to the consultation will help inform the final decision.

Enforcement of the private hire vehicle licensing regime is a matter for licensing authorities and the police. Any licensed private hire vehicle operators found to be enabling the use of unlicensed drivers or vehicles to carry passengers may be prosecuted and risk revocation of their licence.

Legislation allows taxis and private hire vehicles to operate outside of the area in which they are licensed. Taxis can only ply for hire (pick up passengers at taxi ranks or be hailed in the street) in the area in which they are licensed. Pre-booked work by private hire vehicles and taxis can be undertaken anywhere. This allows the sector to work flexibly to meet the needs of their passengers.
The Government however recognises concerns around out-of-area working and is considering options to strengthen the regulation of the sector.

That this House expresses its unequivocal solidarity with Uber and other private hire drivers across the UK, recognising the vital role they play in the modern transportation network; notes with concern the ongoing challenges they face including precarious working conditions, potential algorithmic discrimination, insufficient pay, and lack of employment rights; acknowledges the findings of the Taylor Review of Modern Working Practices which highlights the urgent need for employment protections and fair treatment in the gig economy; calls on the Government to implement robust measures to protect these workers from exploitation, ensuring they receive fair pay, sick leave, and holiday entitlement; and urges Uber and other private hire companies to adhere to UK employment laws as ruled by the Supreme Court, end any algorithmic discrimination taking place, and treat their drivers with the dignity and respect they deserve.

An individual’s entitlement to employment rights such as the minimum wage are determined by their employment status (employee, limb (b) worker or self-employed). In 2022, the Government published new employment status guidance, making it easier for businesses to comply with existing regulations and for individuals to understand which employment protections apply to them.
