To ask the Secretary of State for Business and Trade, what the status is of the Certification Officer’s investigation into the Unite trade union and the hotel development.
The Certification Officer has appointed an inspector to investigate the financial affairs of Unite the Union. The inspector's work is continuing and upon its conclusion, the Certification Officer will publish the report on the Certification Officer's website.
That this House welcomes Unite the Union’s safety campaign entitled Abuse Doesn't Fly; notes with concern the widespread abuse, aggression, and physical assaults reported by airport workers across the aviation sector; regrets the severe impact this hostility has on the wellbeing of staff, the travel experience of passengers, and the operation of airports, particularly ahead of peak holiday seasons; and urges airport employers, police authorities, and the Government to support the introduction of a traffic-light banning system for repeat offenders, stronger physical security measures for the protection of staff, and access to counselling services for workers suffering mental health impacts as a consequence of such abuse.

To ask the Secretary of State for Business and Trade, whether the Certification Officer has made an assessment of when Unite will submit full accounts for publication on gov.uk, including backdated accounts.
The Certification Office has received Unite the Union’s annual return for 2021. Publication of that return is currently being held pending the conclusion of related statutory processes, which are nearing their conclusion. Once those processes have concluded, the Certification Officer will arrange publication in the usual way.
In respect of Unite’s other outstanding annual returns, the Certification Officer remains in regular dialogue with the union regarding their submission. The Certification Officer expects the receipt and publication of those returns to follow the publication of the 2021 return.

The Certification Officer operates independently of Government and is responsible for the conduct of investigations within his statutory remit. It is therefore for the Certification Officer to determine the timetable for the investigation. The Certification Officer has appointed an inspector to investigate the financial affairs of Unite the Union, including in respect of certain matters raised in the report referred to. Upon conclusion of the inspection, the Certification Officer will publish the inspector's report on the Certification Officer’s website as soon as reasonably practicable.

The Government continues to engage with a wide range of stakeholders as part of the development of policy on the Automated Passenger Services permitting scheme.
Policy has been developed holistically, taking account of the full range of consultation responses and ongoing engagement. Feedback from Unite the Union has been considered alongside evidence from other trade unions, industry stakeholders, safety bodies and the public. This input has informed the overall policy approach to the pilot scheme, particularly the emphasis on passenger safety, local authority engagement and workforce impacts.

We have been clear that the government is not a party to the ongoing waste dispute, and this is a local matter that the relevant parties must resolve. Like all authorities, Birmingham City Council has legal duties with which its statutory officers must ensure compliance, including in relation to equal pay and the ongoing waste dispute. Throughout the all-out strike, Commissioners have consistently outlined that any resolution to the dispute must be lawful, must represent value for money and must not exacerbate unfairness relating to equal pay. Commissioners have also set out that any possible agreement with Unite must be approved through the Council's formal processes.

The success of Birmingham is vital for the wider region, and the government therefore takes the progress made across Birmingham City Council very seriously. My department regularly engages with both the Council and Commissioners, alongside receiving regular updates on progress, including on the waste dispute.
While the government is not a party to this dispute, we continue to urge both parties to work together to bring about a sustainable solution to end the strike, in the interests of the people of Birmingham.

As previously publicly notified, an inspector, duly appointed by the Certification Officer, is carrying out the inspection under statutory powers. Accordingly, the Certification Officer is allowing that process to proceed. No formal notices have been served by the Certification Officer.
Section 33(7) of the Trade Union and Labour Relations (Consolidation) Act 1992 makes it an offence for any official or agent of a trade union to destroy, falsify or make false entries in documents relating to the union’s financial affairs.
BDO is a private entity, and the government cannot comment on its actions.

The Secretary of State has not met with Birmingham City Council or the Commissioners regarding the refuse workers’ strike. My department engages regularly with Birmingham City Council as is normal for all Councils under intervention. This matter, and the wider waste dispute, is a local issue and is rightly being dealt with by the Council.
Commissioners are experienced local government professionals and are appointed to Birmingham City Council to support its recovery and improvement journey. They have powers relating to governance, finance and recruitment which they can use according to their expert judgement and discretion.
More widely, the government is under no illusions about the scale of the wider financial challenge facing councils following more than a decade of cuts by successive governments. The government is therefore supporting the Leader and his team in Birmingham, directly and through the Commissioners, to move the council on from its historic issues. From 2026-27, the government is making good on long overdue promises to fundamentally update the way we fund local authorities, realigning funding with need and deprivation. The government already delivered an increase in Core Spending Power in Birmingham of up to 9.8% in 2025-26 and will further support councils through the first multi-year Local Government Finance Settlement in a decade.

The Certification Officer has appointed an inspector to carry out the inspection in accordance with the Trade Union and Labour Relations (Consolidation) Act 1992. Under this process, the inspector has the statutory authority to require the production of relevant documents and digital information, and is empowered to request assistance, attendance and documentation, from officials and agents connected to the union, as well as from others who may be in possession of materials and information he considers relevant to his inspection, and it is their duty to comply. These powers ensure that the inspector can conduct a thorough and effective investigation.

The Certification Officer is required to publish a final report following an inspection, which includes the name of the inspector appointed to any such inspection. While the legislation does not specify a timeline for publication, it is expected that the Certification Officer will take a short period to reflect on the findings, consider any next steps, and provide a copy of the report to the union before publication. In respect of the funding of the BDO report, this is a matter for the union itself. The Certification Officer received this report to assist in fulfilling his statutory duties.
