The hon. Gentleman raises a really important issue. He will know that there is live enforcement action ongoing, so it would be inappropriate for me to comment further on specific details, but if he wants to have a private conversation, I would be happy to arrange one.

What enforcement action is the Environment Agency taking against Viridor, the operator of the Beddington energy recovery facility, due to 18 months of exceedances of daily limits of NOx? Can the Minister also confirm that the permit increase request for the ERF will finally be refused?

To ask the Secretary of State for Environment, Food and Rural Affairs, how many invalid emission reporting results there were at the Viridor energy recovery facility incinerator on Beddington lane in south London during January 2020.

The Environment Agency (EA) as the regulatory body for the site will receive the returns from the operator for January 2020. These will be submitted to the EA in April 2020 as part of the quarterly reporting process. This information is then reviewed and validated by the EA. Following this process the EA will be able to confirm the number of invalid emissions, if any.

The Environment Agency (EA) regulates the Energy Recovery Facility (Erf) in Beddington Lane, Sutton through an Environmental Permit under the Environmental Permitting Regulations 2010. The permit has strict conditions relating to acceptable levels of emissions of substances. The ErF operator (Viridor) is required to continuously and periodically monitor the emissions from the Erf stacks and submit the monitoring data quarterly to the EA.
The EA assesses all data submitted including breaches in emission limits for trends and requires the operator to investigate issues and take actions to rectify them.
The quarterly monitoring data that covers January 2020 is due to be submitted to the EA before end of April 2020. The EA have not received any notifications for breaches in emission limits during January 2020.

The maximum throughput of waste specified in the permit for Viridor’s Runcorn Energy from Waste site is 850,000 tonnes per year. This was based on the predicted number and length of plant stoppages for inspection, maintenance and repair. In 2017 this routine shut down was shorter than expected, and the Environment Agency authorised a temporary increase of throughput on a trial basis. The total throughput of waste for 2017 was 890,933 tonnes. This increase will not have led to an unacceptable impact on the environment.
Viridor will need to apply for a permit variation in order to permanently increase its annual throughput of waste. Any such permit variation is likely to be subject to public consultation.
There has been no change in fuel composition from that specified in the permit in 2009.
To ask the Secretary of State for Environment, Food and Rural Affairs, for what reason the composition of fuel being burned at the Viridor Runcorn Energy from Waste facility been allowed to be changed from that permitted under its original permit.

To ask the Secretary of State for Environment, Food and Rural Affairs, if he will take action against Viridor for exceeding its permit level for waste disposal at its Runcorn Energy from Waste site.
The Environment Agency (EA) does not intend to take any enforcement action as a consequence of Viridor exceeding its permit level for waste disposal at its Runcorn Energy from Waste site. The exceedance was authorised by the EA on a temporary trial basis due to the plant’s routine shut-down period being shorter than usual, and will not have led to an unacceptable impact on the environment. Viridor will need to apply for a permit variation in order to permanently increase its annual throughput of waste. Any such permit variation is likely to be subject to public consultation.

The Landfill Communities Fund allows a landfill operator to gain a tax credit against 90 per cent of the voluntary donations it makes to environmental bodies for spending on certain prescribed objectives. The restoration of a building of historic interest or place of religious worship within the vicinity of a landfill site is one of these objectives.
ENTRUST, the regulator of the Landfill Communities Fund publishes guidance which describes the vicinity of a landfill sites as within approximately 10 miles of a site. The works at Wilton Music Hall and All Saints Church fall within this range.
