Mr. David Shaw: To ask the Secretary of State for the Environment what is his policy on the award of costs at hearings held in connection with the functions of the Environment Agency or appeals against the agency. [21654] Mr. Clappison: Subsection 250(5) of the Local Government Act 1972 enables the Secretary of State to make an order as to the costs of the parties at an inquiry and as to the parties by whom the costs are to be paid. Subsection 53(2) of the Environment Act 1995 applies subsection 250(5) of the 1972 Act to inquiries and other hearings held in connection with the functions of the Environment Agency or the Secretary of State's functions in relation to the agency. These include appeals over integrated pollution control authorisations and waste management licences under the Environmental Protection Act 1990, waste carrier licences under the Control of Pollution (Amendment) Act 1989, and abstraction licences and discharge consents under the Water Resources Act 1991. The parties at these hearings are normally expected to meet their own expenses irrespective of the outcome. Costs are awarded only on grounds of "unreasonable" behaviour resulting in unnecessary expense. An award of costs does not therefore follow the event of the decision on merits. In considering the award of costs, the Secretary of State will apply by analogy the guidance on award of costs in planning proceedings in DOE circular 8/93 (Welsh Office 23/93). The circular includes a summary of the criteria for unreasonable behaviour and advice on the general principles for awards of costs for unreasonable behaviour, general procedural requirements, and applications for costs. Section 53 of the 1995 Act enables costs to be awarded only in cases where a hearing is held. Unlike planning proceedings, costs are not available where a hearing is cancelled due to a party's withdrawal. Subsection 250(5) of the 1972 Act does not apply to proceedings in connection with local authority air pollution control decisions under part 1 of the Environment Protection Act 1990. Consideration will be given to seeking such provision in due course.

[18099] Mr. Roger Evans: This is an operational matter for Peter Mathison, the chief executive of the Benefits Agency. He will write to the hon. Member. Letter from Peter Mathison to Mr. David Shaw, dated 17 March 1997: The Secretary of State for Social Security has asked me to reply to your recent Parliamentary Question asking what procedures exist to ensure that parents whose children are sentenced to be detained, do not continue to receive a) Child Benefit and b) other benefits in respect of them. Customers receiving Child Benefit are obliged to report any changes of circumstances in accordance with the instructions contained in their order book. This would include instances when a child is detained in legal custody. Similarly, those in receipt of Widows Benefit, Retirement Pension, Income Support or short term benefits which include an additional amount for a dependent child must report the changes. Customer receiving benefit by Automated Credit Transfer are periodically sent details of what changes of circumstances should be reported. The position is different for people receiving Family Credit (FC). Entitlement is calculated and benefit is awarded for a fixed period for a family's circumstances at the date of the claim. If a child subsequently leaves a household, entitlement continues unless the child is included within another family claiming FC. There are no provisions within FC legislation for payments to cease in any other circumstances involving children. I hope you find this reply helpful.

Mr. David Shaw: To ask the Chancellor of the Exchequer if he will list the main price indices used in each EU member state; and what assessment he has made of their (a) basis, (b) data collection procedures and (c) methods of calculation relative to those used in the United Kingdom. [17356] Mr. Oppenheim: The information requested falls within the responsibility of the chief executive of the Office for National Statistics. I have asked him to arrange for a reply to be given. Letter from Tim Holt to Mr. David Shaw, dated 5 March 1997: The Chancellor of the Exchequer has asked me to reply as the Director of the Office for National Statistics to your recent question on the main price indices used in each EU Member State; and what assessment has been made on their basis, data collection procedures and methods of calculation relative to those used in the United Kingdom. All EU Member States produce a consumer price index (CPI) based on the expenditure patterns of consumers in their country for national purposes. The last study of EU national prices indices was carried out by Rudolf Teekens of the Institute of Social Studies in the 1989 Eurostat, the Statistical Office of the European Communities, publication Consumer Price Indices in the EC-- Similarities, Differences and Proposals for Harmonisation, a copy of which is available in the House of Commons Library. A table from the report listing the main prices indices for each country is attached. This is the latest information available but it is possible that the situation has changed since the report was produced. In addition to nation price indices the EU Member States have been working with Eurostat for over three years to produce harmonised measures of inflation expressly for the purposes of comparisons across Member States. This has involved assessment of the basis of the indices, the data collection procedures and the method of calculation in each country. These harmonised inflation figures will be used to inform decisions on which Member States meet the conditions to participate in EMU under Article 109j of the Treaty on European Union. However, they are not intended to replace existing national CPIs. The RPI remains the best indicator of UK consumer price inflation. This programme of harmonisation has lead to the production of Harmonised indices of consumer prices (HICP) by each Member State, Norway and Iceland. The first figures for all 15 Member States will be published by the EC on 7 March 1997. The figures for the UK were published by ONS on 26 February 1997. Mr. David Shaw: To ask the Chancellor of the Exchequer if he will list the accounting treatments being adopted by each EU member state in their 1996 and 1997 national accounts which differ from United Kingdom practice; and what assessment he has made of the expected effect of each difference. I have asked him to arrange for a reply to be given. Letter from Tim Holt to Mr. David Shaw, dated 3 March 1997: The Chancellor of the Exchequer has asked me as the Director of the Office for National Statistics to reply to your recent question on the accounting treatments being adopted by each EU member state in their 1996 and 1997 national accounts which differ from United Kingdom practice; and what assessment he has made of the expected effect of each difference. There is a requirement for certain statistics relating to European Monetary Union convergence to be compiled and reported to Eurostat in line with the European System of Accounts, second edition (ESA79). For the purposes of excess deficit criteria, the European System of Accounts (ESA95) Regulation 2223/96 requires that 1 September 1999 reports will be the last to be submitted on an ESA79 basis. ESA79 is used as the basis for accounting treatment for the debt and deficit criteria for EMU. There are some differences in treatment between member states. In these cases, in order to ensure better comparability for the debt and deficit procedure, after consultation with statistical experts from member states, The Statistical Office of the European Communities (Eurostat) takes decisions on methodological rules to be applied by member states. Eurostat visits member states to check compliance with these rules. However, no specific assessment has been, or could realistically be, made of the effects of differences in treatment in other countries' own accounts from UK practice. UK accounting treatment is described in United Kingdom National Accounts--The Blue Book, published annually by the Office for National Statistics. Council Directive 89/130/EEC, Euratom, of 13 February 1989 (known as "the GNP Directive") requires that member states provide data on Gross National Product at market prices (GNPmp) on an ESA79-basis for own resource purposes annually to the Commission. The Directive also requires member states to provide the Commission (Eurostat) with an inventory of the procedures and basic statistics used to calculate GNPmp and its components. The GNP Committee has the job of examining compliance of GNPmp data with ESA79 definitions, and examining the statistical sources and the procedures used for calculating GNPmp and its components. Data for 1996 have not yet been compiled by member states. What treatment has been adopted--and any differences between countries--will not become clear until these accounts are published, or submitted to Eurostat. Therefore any comparison of differences in treatment between the UK and other member states could not yet be done for latest years. For the national accounts in general, in advance of the introduction of ESA95, there is no statutory framework which determines treatment to be adopted by each member state in their national accounts as a whole. As I mention above, Eurostat does however maintain copies of inventories describing the procedures and basic statistics in that part of the accounts used to calculate data on Gross National Product at market prices (GNPmp) and its components, required under the GNP Directive for own resource purposes.
