My Lords, tackling dementia is an urgent priority and the Government are committed to the delivery of better-quality care for all those with dementia. Ensuring that people with impaired faculties or disabilities receive the best type of care that they require is one of the reasons we are accelerating the pace of improvement through a focus on local delivery and accountability.

My Lords, the Government have presided over huge investment in higher education, with spending up some 25 per cent since 1997 and significantly increased income to higher education from variable fees. This year the department is allocating some £15 billion to higher education, taking into account spend on institutions and students. Results from the national student survey show that students are very satisfied, with 80 per cent and over consistently rating their teaching experience highly for the past five years.

My Lords, as with all government funding, the financing of services for people with dementia was last reviewed as part of the spending review period which ends in 2010-11. Future funding for services for dementia after 2011 will be determined as part of the next spending review, being decided now.

Thalidomide survivors are already compensated through a private settlement agreed between the Thalidomide Trust, the body established to administer payments to survivors, and Diageo PLC. We have no plans to meet representatives from Diageo to discuss further compensation. This is a matter solely for the parties concerned.
Those living with the effects of thalidomide are able to access the full range of health and social care. My colleague, the Minister of State for Health, has already met the National Advisory Council to the Thalidomide Trust and hopes to meet it again on 22 October to explore ways of improving access to personal budgets and direct payments in social care, as well as developing a pilot that tests the use of personal budgets for thalidomide survivors. This will potentially tailor help to each individual according to their needs.

The Green Paper Shaping the Future of Care Together lays out the Government's vision for a national care service and considers how we can make this fair, simple and affordable for everyone. As part of this, we will need to consider how best to target resources at those most in need of support. The Green Paper is an opportunity to consider a range of options on how best to achieve this. We are currently consulting on all of the options considered in the Green Paper, in our Big Care Debate, which will run until 13 November this year.

My Lords, the Green Paper, Shaping the Future of Care Together, proposed that one way to deal with the challenge of an ageing society may be to bring some disability benefits and the new care and support system together into a single system as a better way of providing support. At this stage, we do not want to rule out any options and so are considering all disability benefits.

My Lords, the Government have made progress with a number of proposals to assist independent living for disabled people. These include the common assessment framework for adults; the fairer contribution guidance, which will be published soon; regulations to allow direct payments to be made to adults lacking capacity, from autumn 2009; ratification of the United Nations convention for disability rights on 9 June; and the soon-to-be-published Care and Support Green Paper.

My Lords, the Government have a comprehensive programme of action to tackle all violence. Violence against disabled people, when motivated by that disability, is a hate crime. The Home Office is leading the development of the cross-governmental action plan to tackle hate crime and the Race for Justice Programme, led by the Attorney-General, is developing a cross-governmental approach to the way the criminal justice service responds to it.

The regulation of adult social care is now the responsibility of the new independent regulator, the Care Quality Commission (CQC), which took over from the Commission for Social Care Inspection, the Healthcare Commission and the Mental Health Act Commission on 1 April 2009.
The training of inspectors is the responsibility of the CQC. The commission has advised that for a person to be recruited as a social care inspector, the CQC requires that a social work qualification be held (for example a Diploma in Social Work) or that they are a registered nurse (level 1 minimum). However, the commission may also recruit candidates with other qualifications such as an occupational therapy or a teaching qualification to the role of the inspector, if they have relevant experience.
The commission is committed to providing experienced and well-trained staff and as such delivers an extensive programme to its inspectors on its Inspecting for Better Lives methodology, its systems and equality and diversity issues.

I am informed by the Care Quality Commission (CQC) that the Commission for Social Care Inspection (CSCI) had the power to cancel the registration of individual care services such as care homes, nursing homes and domiciliary care agencies. CSCI also had powers to cancel the registration of registered managers. CQC retains CSCI's powers of enforcement.
Cancellation of registration is not necessarily equivalent to closing down a care company, as such providers may hold multiple registrations for individual services provided, or managers registered, in various locations.
During its period of office, from 2004-05 to 2008-09, CSCI carried out 309 non-urgent and 28 urgent cancellations of registration.

Under the Care Standards Act 2000, the commission's inspectors have powers to:
require a provider of a regulated activity to provide information, whether registered with the commission or not;
enter and inspect premises which they believe to be used for a regulated activity;
examine the state and management of any relevant premises;
examine the treatment and care of patients or people using the service; inspect and take copies of documents and records; interview the manager, staff or people using the service; examine patients or people using the service; seize documents, materials or other things;
require any person to help with the investigation; and
take measurements and photographs that may be necessary in carrying out the above powers.
Any person who intentionally obstructs the exercise of these powers, or fails to comply without reasonable excuse is guilty of an offence.

The Care Quality Commission (CQC), as regulator of social care, inspects care providers against statutory regulations and national minimum standards and has powers of enforcement, which it may use at its discretion, depending on the nature/severity of any breach of regulations. The range of powers is:
a formal non-statutory caution;
a notice requiring improvement within a specified time period;
conditions that place restrictions on registration (for example, preventing the provider running a particular service or preventing further admissions to a service);
prosecution of organisations and/or individuals—resulting in fines or, in extreme cases, imprisonment; and ultimately
cancellation of registration, which closes the service down.
From 2010, the CQC will be introducing a new system of registration under the Health and Social Care Act 2008, which will give it additional powers designed to bring providers back into compliance where they are not providing acceptable levels of care. The full range of powers will be:
a formal non-statutory caution;
a new statutory warning notice, requiring improvement within a specified time; conditions that place restrictions on registration (for example, preventing the provider from running a particular service or preventing further admissions to a service);
a new power to issue a fine in lieu of prosecution (penalty notice);
a new power to suspend registration for a specific period;
prosecution of organisations and/or individuals—resulting in fines or, in extreme cases, imprisonment; and ultimately
cancellation of registration, which closes the service down.

I am informed by the Care Quality Commission (CQC) that, when carrying out an inspection, it provides surveys to help reach a range of people who have an interest in the quality of the services being inspected.
Surveys are provided in different formats to make them accessible to more people. The CQC compares information from these surveys with other evidence that has been gathered to form a judgement about the quality of the care provided.
The surveys include optional questions about equality and diversity to help the CQC to understand how well the service is meeting the needs of people from a diverse range of backgrounds.
However, the responsibility for measuring the impact on, and outcomes for, service users rests with the local council that commissions the service. Evidence from local involvement networks, national surveys and Commission for Social Care Inspection surveys obtained from service and regulatory inspections will give appropriate opportunities to triangulate the results with councils' own monitoring and survey work to form a view on the quality of services.

Monitoring of adult social services' efficiency in England is undertaken by a number of organisations: the Care Quality Commission (CQC), as part of its role as the independent health and social care regulator, the Audit Commission, and the Department of Health.
The CQC was established by the Health and Social Care Act (2008) and replaced the Commission for Social Care Inspection, as well as the regulators for healthcare and the Mental Health Act. Under the provisions of the 2008 Act, the CQC carries out a number of activities related to the regulation of local health and social care services, including registration of providers to ensure minimum quality standards are met, regular reviews of providers and commissioners of services, and inspections of particular care services.
The CQC undertakes periodic reviews of all local authority adult social services, and publishes its assessment of the quality of those services, and their capacity to deliver improved outcomes for local people. This judgment includes a specific criterion on the local authority's efficient use of resources to meet the needs of its local community.
The CQC's assessment of adult social care is further used as part of the evidence base for the annual comprehensive area assessment (CAA) published by the Audit Commission. The CAA, which will be published for the first time in October 2009, brings together the assessments of six national regulators to form an overall judgment of the delivery of public services in a locality. It will publish an area assessment (providing an overall judgment on the locality) and an additional organisational assessment of the local authority management. This latter assessment will make a scored judgment on two corporate areas: managing performance and use of resources, and so will contribute towards the checks on efficiency in adult social care.
The Department of Health also works to support efficiency in adult social care, and has put in place a number of programmes to help local authorities achieve efficiencies. For instance, the Care Services Efficiency Delivery programme has invested about £5 million per year to specifically support the local efficiency agenda through working with local authorities to improve planning and procurement, developing more efficient systems for the assessment and delivery of care with a strong focus on re-ablement and recovery. Additionally, the Partnership for Older People Projects have supported 19 local pilot programmes to develop a wide range of innovative services and focus on early interventions to reduce long-term care needs.

The Domiciliary Care Agencies Regulations 2002 and associated national minimum standards (NMS) set out the qualifications required of staff who are employed to care for people in their own homes.
The regulations require that all care workers must have integrity and be of good character, have the experience and skills necessary and be physically and mentally fit for the purposes of the work which they are to perform.
The NMS for Domiciliary Care Agencies require that care or support workers delivering personal care who do not already hold a relevant care qualification are required to demonstrate their competence and register for the relevant NVQ in care award—either National Vocational Qualification in Care level 2 or level 3—within the first six months of employment and complete the full award within three years.
The regulations stipulate that agencies should ensure that employees receive training and appraisal which are appropriate to the work they are to perform, together with suitable assistance, including time off, for the purpose of obtaining qualifications appropriate to such work.
