Legal Aid: Nationality

Question
To ask the Secretary of State for Justice pursuant to the answer of 21 June 2011, Official Report, column 179W, on legal aid: Iraq, for what reasons the Legal Services Commission does not record the nationality of claimants; and if he will instruct them to do so.
Answer

The Legal Services Commission does not identify or record the nationality of claimants as this is not one of the criteria used to decide whether a person should receive legal aid. The fact that an applicant may live abroad is not a factor in the decision-making process under the legal aid scheme. The rules for scope and qualification are in legislation or other documents laid before Parliament.
