European Court of Justice

Question: To ask Her Majesty’s Government under what articles of the European Union treaties the European Court of Justice has the power to arbitrate in wages and salaries disputes between employees of the Commission and the European Council and those institutions.

Answer: Article 270 of the Treaty on the Functioning of the European Union states that: "““The Court of Justice of the European Union shall have jurisdiction in any dispute between the Union and its servants within the limits and under the conditions laid down in the Staff Regulations of Officials and the Conditions of Employment of other servants of the Union””." In the first instance, the Civil Service Tribunal has the jurisdiction to hear and determine such disputes. The decisions given by the tribunal may, within two months, be subject to an appeal, limited to questions of law, to the General Court.
