Question: To ask the Secretary of State for Transport, whether it is mandatory for a transport manager to be in the employment of the licence holder under EU Directive 96/26.

Answer: Mr. Peter Duncan: To ask the Secretary of State for Transport whether it is mandatory for a transport manager to be in the employment of the licence holder under EU Directive 96/26. [135272] Mr. Jamieson: Section 58 of the Goods Vehicles (Licensing of Operators) Act 1995 defines a transport manager as "an individual who is in, or is engaged to enter into, the employment of the holder of a standard licence who, either alone or jointly with one or more other persons, has continuous and effective responsibility for the management of the transport operations of the business". This complies with the requirements of EU Directive 96/26/EC in respect of transport managers. It is for the statutorily independent traffic commissioners who administer the goods operator licensing system to interpret the law and to satisfy themselves that transport managers meet its requirements.
