Question: To ask the Secretary of State for Foreign and Commonwealth Affairs, what the Government's policy is with regard to the handing over to the Iraqi authorities of Iraqi detainees who could face the death penalty. (Holding answer 16 September 2004).

Answer: Mr. McNamara: To ask the Secretary of State for Foreign and Commonwealth Affairs what the Government's policy is with regard to the handing over to the Iraqi authorities of Iraqi detainees who could face the death penalty. [189326] Mr. Rammell: [holding answer 16 September 2004]: Under CPA Memorandum 3. which applies to UK forces post 28 June, we are required to hand over apprehended persons suspected of having committed criminal acts to the Iraqi criminal justice system as soon as practically possible. We have lobbied and will continue to lobby the Iraqi Government against the application of the death penalty in all cases.
