To ask Mr Chancellor of the Exchequer, what estimate he has made of the likely reimbursement of tax revenues necessary if actions of a similar class to the Marks and Spencer case against the Inland Revenue at the European Court of Justice are successful.

Mr. Sayeed: To ask the Chancellor of the Exchequer what estimate he has made of the likely reimbursement of tax revenues necessary if actions of a similar class to the Marks and Spencer case against the Inland Revenue at the European Court of Justice are successful. [213969] Dawn Primarolo: It is impossible to assess how many other potential litigants are in the same circumstances as Marks and Spencer. Consequently, it is not possible to quantify the amount of tax potentially reimbursable.
