Safeguarding Vulnerable Groups Bill [HL]
I will speak briefly, because I want to read with great care what the Minister said, both in response to Amendment No. 57 and those proposed by the noble Baroness, Lady Walmsley. This is a difficult area, but I hope and trust that the Minister is erring very much on the side of caution here to minimise risk, until it is reasonably known that risk either does or does not exist. For example, in relation to Amendment No. 58, I was interested in what the Minister said about an employer not being duty-bound to employ a person, notwithstanding the fact that that person may not be barred from working in a regulated activity. If that is the case, I hope that there is read-across with the employment tribunals so that the employer is protected if he decides not to employ someone if they are not barred from working in a regulated activity. I also need to read what the Minister said in response to my Amendment No. 57, given that we are concerned that while a process is underway a person may be able to work with children or vulnerable adults again. I will reserve my thoughts and see whether I might return to those points on Report.
