Proceeding contribution from Baroness Walmsley (Liberal Democrat) in the House of Lords on Tuesday, 2 May 2006. It occurred during Debate on bill and Committee proceeding on Safeguarding Vulnerable Groups Bill [HL].

Safeguarding Vulnerable Groups Bill [HL]

I thank the Minister for his response to the amendments and, in particular, for telling the Committee that he will give further consideration to Amendment No. 54. I hope that he will come back with a better form of wording to achieve our shared objective of making sure that we are fair to everybody and that everybody is properly informed about the situation. I was delighted to hear the Minister say in response to Amendments Nos. 80 and 81 that there is no wish to criminalise people unnecessarily and that when people are informed that they are barred, which they will be, they will be told what they cannot do at the same time. I hope that that will dispel some of our concern about the wide scope of what is listed under ““regulated activity””. Similarly, the Minister said in response to Amendment No. 86 that there is no intention to criminalise unfairly. An awful lot depends on the efficacy of the information programme that is planned following the implementation of this Act and on the implementation of rigorous processes by employers of all sizes. That may be relatively easy for large employers, such as local authorities, but I worry a little about small employers being criminalised for something that perhaps they could not reasonably have been expected to do. However, they will all have to try a bit harder to protect children and vulnerable adults. I am still a little concerned about the words ““on an occasional basis”” and ““frequent””. I wonder whether the information programme will be clear about what is meant by those words and phrases, which I fear are rather vague. I thank the Minister particularly for his response to Amendment No. 54 and I beg leave to withdraw the amendment. Amendment, by leave, withdrawn. [Amendment No. 55 not moved.] Clause 3 agreed to. Clause 4 [Appeals]: [Amendments Nos. 56 to 59 not moved.] Clause 4 agreed to. Clause 5 [Regulated activity]:
