Electoral Administration Bill
I completely agree with what the noble Lord, Lord Goodhart, has said, particularly on the burden of proof. This is less favourable to the defendant. The prosecution has to prove beyond reasonable doubt either knowledge or that the individual ““ought reasonably to have known””. This defence would have to be proved by the defence on the balance of probabilities. I adopt all that the noble Lord, Lord Goodhart, has said and have nothing to add to the brilliant way in which he said it. I, therefore, invite the noble Lord, Lord Kingsland, to withdraw his amendment.
