moved Amendment No. 45: 45: Clause 29 , page 14, line 31, at end insert— ““(3A) With regard to subsections (1) to (3), the Board must satisfy itself that approved regulators have established organisational structures and procedural practices which distinguish sufficiently clearly between their regulatory and representative functions.”” The noble Lord said: Again, this is a probing amendment. It is designed simply to elicit a short answer from the noble Baroness which I am reasonably confident she will be able to give. The amendment seeks to probe the ability of the Legal Services Board to ensure that the approved regulators have established an adequate distinction between their regulatory and representative functions. We are all agreed that this distinction, as exemplified by the debate on the previous amendment, will be crucial to the effective work of the Legal Services Board. Amendment No. 45 has been put forward to seek an assurance from the Minister to that effect. I beg to move.
