My hon. Friend is absolutely right. The issue arose in Committee, where my hon. Friend the Member for Glasgow, North (Ann McKechin), said that"““prosecutions should be taken if they are in the public interest””––[Official Report, Regulatory Enforcement and Sanctions Public Bill Committee, 17 June 2008; c. 71.]" Allowing a person to choose whether or not they are prosecuted would go against that understanding.
