Proceeding contribution from Lord Hain (Labour) in the House of Commons on Wednesday, 14 October 2009. It occurred during Debates on delegated legislation on National Assembly for Wales (Legislative Competence) (Welsh Language).
National Assembly for Wales (Legislative Competence) (Welsh Language)
We are not proposing that. However, it will be in order and quite possible for the Assembly to raise the threshold, as I expect it will want to, in framing a Measure or subsequent Measures. It cannot reduce it—that is the important thing about a threshold—but it can raise it sensibly if it chooses to do so. Thirdly, we have agreed a number of changes to remove specific business sectors that, on reflection, do not need to be included in the LCO. We are redrafting the order to exclude shops, as we do not wish to include them in the LCO’s scope other than in specific cases such as post offices. The exclusion will ensure that shops do not come within competence inadvertently by virtue of selling products or services related to sectors listed in the order. A small corner shop, for example, might have been caught in that way.
