There is no doubt in my mind that responsibility for the Measure rests with the Welsh Assembly. The legislation we have says that the Assembly is responsible for secondary legislation. However, there is also a grey area and I see some merit in the hon. Lady’s point in this sense: when I was a Welsh Minister, I often entered into correspondence with my colleague Minister in Cardiff who would then give a broad indication. We had no right whatsoever to scrutinise a Measure at any stage but it is always helpful to have an indication. Such an indication would help with the work that my hon. Friend the Member for Aberavon spoke of this morning, to take the issue forward in a united way.
