Proceeding contribution from Cheryl Gillan (Conservative) in the House of Commons on Wednesday, 14 October 2009. It occurred during Debates on delegated legislation on National Assembly for Wales (Legislative Competence) (Welsh Language).

National Assembly for Wales (Legislative Competence) (Welsh Language)

Perhaps the hon. Gentleman should have a word with the Presiding Officer. As with the other documents in front of us today, this measure has no legal status. I have no idea what the intentions are and I do not intend to dictate, but it is essential that the question is asked. The £200,000 threshold was clearly arbitrary, and the Select Committee Chairman’s statement that whatever the limit is, it is problematical, sums it up. I am interested in how the £400,000 threshold has been reached in negotiations, not least because the Select Committee not only made no recommendations about it—probably quite rightly so—but did not even discuss the £400,000 limit. Again, that seems quite arbitrary, and at some stage we need to drill down into the figure and see who would be affected and what sort of inhibitor would operate—or not, as the case may be. There is uncertainty about which organisations would be covered. For example, if an organisation did not receive the sum of £400,000 annually, but over two consecutive financial years, would the order cover it in perpetuity, or would its responsibilities lapse once it stopped receiving the funds? There are devils in the detail that we should be considering in this place, even though the Assembly will be making the Measure. In his letter of 5 October, the Secretary of State said he would specify which bodies established by royal charter would be covered by the legislation. I presume that at some stage he will let us have a written list of his estimates of which bodies will be covered.
