Mr. Wray: To ask the Secretary of State for Health what protection is afforded to nurses and other medical staff in the workplace from members of the public; what assistance is given by the police to hospitals and other medical treatment centres; and what recent measures he has introduced to improve co-operation. [128112] Mr. Hutton: Responsibility for tackling assaults against staff working in the National Health Service passed to the Counter Fraud and Security Management Service (CFSMS) on 1 April 2003. During 2003-04, the CFSMS will be taking forward a number of initiatives to reduce the number of both physical and non-physical assaults. The CFSMS is currently developing: conflict resolution training for all frontline staff including nurses and general practitioners as a key preventative measure to reduce the number of incidents; a national and consistent reporting system to record incidents of physical assaults on staff, using a common definition, with the ability to track cases from report to conclusion. This will allow for intervention where appropriate in order to ensure the best possible outcome for the victim concerned and help increase the rate of offenders prosecuted; a consistent locally managed reporting system will be established to deal with non-physical assaults using the common law definition. Clear definitions of assault swill enable sanctions that are appropriate to the incident to be sought; a legal protection unit to provide health bodies with advice on cost-effective methods of pursuing a wide range of sanctions against offenders including criminal and civil action where appropriate; ways in which technology can be used to provide better protection for staff. This work is undertaken in co-operation with the Home Office; a Memorandum of Understanding with the Association of Chief Police Officers (ACPO) to ensure that a consistent national approach to reducing physical and non-physical assaults on staff is taken by both the NHS and the police.

Mr. Wray: To ask the Secretary of State for Health what targets were set in the Zero Tolerance campaign; what progress has been made; and how many targets have been met. [128111] Mr. Hutton: In 1999, in its "working together" framework, the Government set the National Health Service trusts three targets to reduce the number of incidents of violence against NHS staff: by April 2000, to have systems in place for recording incidents of violence to staff and publish strategies to achieve reductions in the levels of violence by: 20 per cent. by April 2001-02; and 30 per cent. by April 2003-04. A recent National Audit Office (NAO) report, "A safer place to Work -- Protecting NHS Hospital and Ambulance Trust Staff from Violence and Aggression", reported that: around 90 per cent. of NHS trusts have violence policies and systems in place for recording incidents; and the majority of NHS trusts did not meet the 2001-02 target for reducing incidents by 20 per cent. The NAO acknowledged that the increase in reported violent and abusive incidents in the majority of NHS trusts was mainly due to improved reporting rates, generally among NHS staff and in particular increased reporting of verbal abuse. The NAO suggests in its report, and this appears to be reflected in the data held by the Health and Safety Executive, that levels of physical assaults are stabilising. Mrs. Dunwoody: To ask the Secretary of State for Health if he will list the terms and conditions under which diagnostic and treatment centres (DTCs) will provide non-urgent surgery to the NHS; how many non- NHS units and companies have been asked to tender; what the (a) nationality and (b) company HQ address is of the non-NHS companies on the list; what terms and conditions will be applicable to non-NHS staff working in DTCs; and what legal protection will be offered to patients receiving treatment outside the NHS from private DTCs. [115174] Mr. Hutton: There will be national health service run and independent sector-run diagnosis and treatment centres (DTCs) providing non-urgent surgery to NHS patients. NHS-run DTCs will be part of NHS trusts and will be subject to NHS governance and standards; independent sector DTCs will be expected to meet independent sector standards and will be regulated and inspected by the National Care Standards Commission. The intention is that the contracts for independent sector DTCs will be based on a standard project agreement containing a common core set of terms and conditions reflecting this. 15 companies have been short-listed and their details can be found at: http:// www.doh.gov.uk/growingcapacity/news.htm This will be updated with further information on a regular basis. To comply with employment and health and safety legislation, guidance on pre and post-employment checks and all clinical staff will need to be registered with the appropriate regulatory body and properly trained and competent to carry out the roles required of them. Patients treated at NHS expense in DTCs will remain NHS patients and their rights as NHS patients will not be affected. They will, for example, have a right to use the NHS complaints procedure, and providers will be expected to co-operate with the investigation of complaints under that procedure.

Mr. Burstow: To ask the Secretary of State for Health how compliance with the Working Together guidelines for child protection is monitored and inspected; which agencies are monitored; and which inspectorates discharge this function. [158888] Mr. Hutton: The social services inspectorate social care regions and inspection groups, and the SSI/Audit Commission joint review team all contribute to the assessment of the performance of each local council with social services responsibilities. Their work is informed by the performance information collected by the local council, through the performance assessment framework. Some inspections cover broad areas of services, such as children's services. Others focus on more specific tasks, such as monitoring the performance of authorities which are subject to special measures. The SSI social care regions monitor the progress made by all councils in implementing the "Government's Objectives for Children's Social Services", progress on major initiatives such as Quality Protects, and action plans to address the recommendations of inspections and joint reviews. Many agencies beyond social services departments have child protection responsibilities. These responsibilities are set out in detail in "Working Together to Safeguard Children". For the first time ever, beginning later this year, there will be a programme of children's safeguards inspections. These inspections will focus on the working of area child protection committees in their implementation of "Working Together to Safeguard Children", and the inter-agency arrangements to assess and address the risks posed by dangerous adults. They will be undertaken by a team of inspectors drawn from each of the inspectorates for the range of agencies with regular contact with children, and will be led by the SSI. It will therefore include inspectors from Ofsted, the Commission for Health Improvement, Her Majesty's Inspectorate of Constabulary, HMI Prisons, and will be supported by the Magistrates Courts Service Inspectorate and the Crown Prosecution Service Inspectorate.

Ms Moran: To ask the Secretary of State for Health if he will list the measures he has taken to tackle domestic violence since May 1997. [159419] Mr. Hutton: We are committed to raising awareness of domestic violence and its impact on children, to tackling domestic violence on every front, and to ensuring that women and children are safeguarded and protected from abuse. In March 2000 we launched the "Domestic violence: A resource manual for health care professionals", and we are providing funding (from 2000-01 to 2002-03) under the Section 64 Scheme to the women's aid federation of England for their health and domestic violence awareness project to help implement the resource manual. Our NHS Direct East Midlands domestic violence pilot project aims to produce protocols for good practice, and train staff to be able to deal with victims of domestic abuse sensitively and refer them to appropriate agencies. We have also held preliminary discussions with representatives of the Royal Colleges to discuss a programme of education and training on aspects of domestic violence for health professionals. Recent work by the Department in relation to child protection in the context of domestic violence includes the "Making an impact--children and domestic violence training pack" which we published in 1998 to raise awareness about the impact on children of domestic violence and to develop professional understanding of how best to offer help and support. There is an undertaking in "Working together to safeguard children" our revised inter-agency guidance to safeguard and promote the welfare of children, published in 1999, to commission overview reports at least every two years, drawing out key findings of case reviews and their implications for policy and practice. The first overview report will have child protection in the context of domestic violence as its central theme. We have commissioned this report and it will be published later this year. In addition, we have provided Section 64 funding to a number of voluntary organisations for a range of projects designed to assist survivors of domestic violence and children caught up in such violence.
