All care homes are subject, under the care Standards Act 2000, to the Care Homes Regulations 2001. All providers of regulated social care services, including care homes, must be registered with and inspected by the Commission for Social Care Inspection (CSCI).When inspecting care providers to assess compliance with the regulations, CSCI must have regard for the relevant national minimum standards (NMS). Compliance with the NMS is not itself enforceable, but compliance with regulations is enforceable subject to the NMS being taken into account. Copies of the regulations and NMS are available in the Library.Regulation 13(6) requires that arrangements shall be made, ““by training staff or by other measures, to prevent service users being harmed or suffering abuse or being placed at risk of harm or abuse””.Standard 18 of the NMS for Care Homes for Older People refers specifically to the protection of service users from abuse. The NMS also refer the reader to further guidance on the prevention of abuse, issued by Action on Elder Abuse, the Association of Directors of Adult Social Services, the Department of Health and the Home Office and the Royal College of Nursing.CSCI has issued a range of guidance relating to the safeguarding of adults, which is available on the CSCI professional website, including:"Safeguarding Adults and the Protection of Vulnerable Adults (POVA): Including an agreed protocol with the Association of Chief Police Officers and the Association of Directors of Adult Services, which sets out how CSCI works with other agencies to make sure people who use care services are safeguarded from abuse. These trends would be identified in CSCI's annual report and PRMs would also meet with providers in order to raise such issues.

The Government regard abuse of vulnerable and older people as unacceptable in all its forms and are determined to root it out.We are addressing the issue in a variety of ways. We set out standards for care and treatment for the national health service and social care services via the national service frameworks for older people and mental health and the White Paper, ““Valuing People: A New Strategy for Learning Disability””.We introduced regulations and national minimum standards for care homes, domiciliary care agencies and adult placements. These are intended to ensure vulnerable and older people can live in a safe environment, where their rights and dignity are respected, staff are properly trained and care is of the requisite quality.We have created independent regulators, the Commission for Social Care Inspection (CSCI) and the Healthcare Commission, and given them the powers they need to take action against poorly performing providers or where abuse occurs. Ultimately, they have the power to close services down.We introduced the Protection of Vulnerable Adults (POVA) Scheme in July 2004, which requires staff who provide personal care to older people in their own homes or in care homes to be subject to statutory checks, including checks of their criminal record. The scheme, which operates as a workforce ban, prevents dangerous or unscrupulous people from gaining access to older and vulnerable people in care homes or being cared for in their own homes.We expect local authorities to play their part. ““No Secrets”” (copies of which are available in the Library), statutory guidance published by the Department of Health and the Home Office in 2000, provides a complete definition of abuse and a framework for councils to work with the police, the NHS and regulators to tackle abuse and prevent it from occurring. On 14 June 2007, I announced a review of the ““No Secrets”” guidance. The case for legislation to protect vulnerable adults will be considered as part of the review and there will be a public consultation later this year.On 14 June, I also announced plans to introduce a new monitoring system to report the extent of abuse across England. This will help address the current information gap on levels of reported abuse. As part of this, the Department will introduce a standardised method for the collection of data on protection of vulnerable adult referrals in England. The Information Centre for health and social care (IC) is leading the work to develop and collect data from councils. The IC anticipates that councils should be in a position to collect the data during 2008-09 and expect to have collected the data, analysed it and be in a position to disseminate the findings by the end of 2009.Local authorities (LAs) have been given specific responsibilities. Statutory guidance issued in May 2006 required them to ensure that Directors of Adult Social Services maintain a clear organisational and operational focus on safeguarding vulnerable adults and that relevant statutory requirements and other national standards are met, including POVA requirements. LAs must make sure the Director of Adult Social Services has the powers and resources necessary to encourage a culture of vigilance against the possibility of adult abuse.The Mental Capacity Act 2005, which came into force on 1 October 2007, introduces a new criminal offence of ill treatment or wilful neglect of a person who lacks capacity.The Department supports the work of the charity, Action on Elder Abuse (AEA). AEA has been awarded a three year section 64 grant, totalling £360,000. This grant covers the three year period from 2007 to 2009 and is to help fund central administrative costs.We are introducing a new centralised vetting and barring scheme for people working with children and vulnerable people. This scheme, as set out in the Safeguarding Vulnerable Groups Act 2006, will extend the coverage of the existing barring schemes and draw on wider sources of information to provide a more comprehensive and consistent measure of protection for vulnerable groups across a wide range of settings, including the whole of social care and the NHS. It will be proactive, with vetting taking place on an individual's first application to work with children or vulnerable adults.The scheme, which will be administered by the new Independent Safeguarding Authority (ISA), will make it far more difficult for abusers to gain access to some of the most vulnerable groups in society. It will start to receive applications from 12 October 2009. When used in conjunction with an enhanced Criminal Records Bureau check, the ISA scheme will provide employers with the most comprehensive vetting service on offer anywhere in the world.CSCI has ongoing discussions with the Department on the prevention of elder abuse. Recent meetings to discuss the issue have included:"The Advisory Group for the review of ““No Secrets””;""The ISA Regulator's Sub Group, to advise on key issues for regulators in relation to establishing the new ISA and vetting and barring scheme; and""The reference group to advise on establishing the national data collection by local councils."CSCI is represented on all of these groups.

On 27 March 2008, the Department and Comic Relief announced £2 million funding for a new joint research initiative to investigate the dignity and safety of older people being cared for in institutional settings. The study will explore the experience of older people, and the staff who care for them, in settings such as care homes, intermediate care and hospitals.The new research is likely to run until April 2011. An advertisement inviting tenders to undertake the research was placed in the Guardian newspaper on 4 June 2008, with on-line registration of interest (ROI) required by 23 June.It will build on research published in 2007, also funded by the Department and Comic Relief, which examined the prevalence of abuse of older people living in their own homes.Although the experience of older people with dementia was not included as a specific aspect in this first study, we envisage that the research in institutional settings will include methods to take account of their experiences.A total of 32 ROIs have been received. These will be sifted shortly. Full research applications are due to be received by 27 August 2008.

The Department will introduce a new monitoring system to report the extent of abuse, based on a new national standardised method for the collection of data on referrals in England. The Department will also review the ““No Secrets”” guidance on developing and implementing multi-agency policies and procedures to protect vulnerable adults from abuse. The case for legislation will be considered as part of the review.The report, ““UK Study of Abuse and Neglect of Older People, Prevalence Survey Report””, was commissioned jointly by the Department and Comic Relief in August 2005. A draft report of the findings of the prevalence survey was submitted at the end of March 2007. Independent peer reviews were commissioned at the beginning of April 2007 and received at the end of April. The final draft of the prevalence survey report was received on 17 May 2007 and published on 14 June.The research, which was produced by the Institute of Gerontology, Kings College, London and the National Centre for Social Research, involved a feasibility study of the ethical and methodological issues that would be faced by extending the work to residential care homes. This is the last stage of the commissioned study and is due to be submitted to the Department in mid July. This will enable the Department to assess if, and how, it may be possible to commission further research with residential care populations.The prevalence survey will have included people with dementia, where they were able to give consent to be interviewed. No proxy interviews, however, were undertaken for those without the ability to consent. Research with people who have severe dementia is extremely difficult, but there are research teams working on innovative methods for involving people with cognitive impairment. The Departments research governance framework reminds researchers of the importance of working as inclusively as possible and the Mental Capacity Act 2005 provides a framework to enable those without capacity to be safely involved in research, where appropriate.To date, the Department has received a wide range of representations on the abuse of older people. The new scheme will be proactive, with vetting taking place on an individual's first application to work with children or vulnerable adults. This will make it far more difficult for abusers to gain access to the most vulnerable groups in our society.Statutory guidance has been issued to local authorities on putting in place multi-agency policies and procedures to protect vulnerable people from abuse. ““No Secrets”” makes it clear that local strategies for the prevention of abuse of vulnerable adults should include plans to disseminate information to users, carers, relevant staff groups and agencies to ensure they are aware of local arrangements including how to report abuse.The Department has commissioned research, jointly with Comic Relief, on the prevalence and nature of abuse of older people who live in their own homes. It will be published later this year.

The guidance, ““Safeguarding Children in Whom Illness is Fabricated or Induced”” was published in August 2002, as supplementary guidance to ““Working Together to Safeguard Children”” (Department of Health,1999). The latter was revised in April 2006, to take account of the Children Act 2004.The purpose of the Department’s project is to review progress of how the guidance on safeguarding children in whom illness is fabricated or induced is being implemented within the national health service. The focus of the project is on health professionals in the context of health systems. There will also be some limited input from statutory agencies such as local authority children services who work closely with health teams on safeguarding children. The project is expected to be completed in 2007. Programme funding to continue the project in 2006-07 in not yet guaranteed.

Specialist services including treatment for sexually transmitted infections, termination of pregnancy and mental health services are available for those children who need them as a result of sexual abuse. For children with less severe mental health problems, it is more appropriate for universal services to provide the psychological support they need than for them to be referred to specialist child and adolescent mental health services.It is important that child and adolescent mental health services (CAMHS) are developed in a way that is responsive to the needs of the populations they serve. The CAMHS standard of the children's national service framework (NSF) sets out the requirement for an assessment of the needs of particular groups of children in the locality who are vulnerable or at risk. The NSF also states the commissioners and services should be able to demonstrate multi-agency partnership working in the following areas: the provision of services to children and young people who may or may not have been harmed, as set out in ““Working Together to Safeguard Children””; contributing to the assessment of complex child abuse cases; the assessment and provision of post-abuse therapeutic services; and services for looked after and adopted children.The Department has been working closely with the Home Office to develop sexual assault referral centres (SARCs). A SARC is a one-stop location where victims of rape and sexual assault can receive medical care and counselling, and have the opportunity to report to the police and undergo a forensic examination. The joint Department of Health and Home Office National Service Guidelines for Developing Sexual Assault Referral Centres (SARCs) was published in October 2005.Since 2003, £1.27 million from the Home Office's Victims Fund has been spent on new and existing SARCS. The Department has an important role in allocating these resources as departmental officials are on the committee that make grant assessments. SARCS currently operate in 14 locations in England and Wales and there are six more due to open in the forthcoming year.The Department and the Home Office are supporting the development of appropriate services for children within existing or new SARCs. St. Mary's SARC in Manchester has established a service for children. In London, Project Amethyst was piloted in 2005-06 jointly by local police and health to provide services for children in association with the three London SARCs (the Havens in Camberwell, Whitechapel and Paddington). A number of the new SARCs scheduled to open will be providing services for children.

Two of the main findings were that high rates of depression, anxiety and post traumatic stress disorder were found and both group and individual psychotherapy were effective and improvement in the patients condition tended to continue after treatment had ended.It is important that children and maternity health services (CAMHS) are developed in a way that is responsive to the needs of the populations they serve. The CAMHS standard of the children's national service framework (NSF) set out the requirement for an assessment of the needs of particular groups of children in the locality who are vulnerable or at risk. The information requested is not collected centrally. There is no statutory requirement for statutory agencies to carry out serious case reviews for vulnerable adults. This is a matter for local decision.The Department, together with the Home Office, issued "No Secrets" as statutory guidance under Section 7 of the Local Authority Social Services Act 1970. It is designed to help authorities to investigate reports of abuse and develop measures for prevention. It requests local authorities to ensure that local communities are aware of the existence of adult protection procedures and that they know where they can report incidents of abuse.It provides a complete definition of abuse and a framework for councils to work with the police, the national health service and regulators and other agencies to tackle abuse and prevent it from occurring.

Mr. Ivan Lewis: The information requested is not centrally collected. But any act of violence or abuse against heads, teachers or
other school staff is one too many. Pupils must respect the authority of school staff, and parents must take their share of
responsibility. That is why we are proposing to extend Parenting Orders.
