Littering is a criminal offence and in recent years we have bolstered councils’ enforcement powers, such as by almost doubling the maximum fixed penalty for littering from £80 to £150. We have also published guidance for local authorities on the design and placement of bins. Alongside this guidance, we provided nearly £1 million across 44 councils to help them purchase new bins to keep litter off the streets.
Councils also have powers to issue Public Spaces Protection Orders. These are a wide-ranging tool which councils can use to prohibit specified activity in a public place where it has a detrimental effect on the quality of life of those in the locality, such as the recreational use of nitrous oxide.
Where nitrous oxide is supplied either knowingly or recklessly for its psychoactive effect, the maximum offence under the Psychoactive Substances Act 2016 is seven years’ imprisonment.

There is a programme of work underway to address alcohol-related health harms and their impact on life chances, including the establishment of specialist alcohol care teams in hospitals and support children of alcohol dependent parents.
The new Office for Health Improvement and Disparities will lead our efforts to improve treatment and support, with £80 million of new investment. We have also committed to publish a new United Kingdom-wide cross-Government addiction strategy which will consider a range of issues, including drugs, alcohol and problem gambling. We will consider the emerging evidence around increased alcohol harms during the pandemic and what further action is needed as we develop the strategy.

In 2020, Dame Carol Black was commissioned to lead an independent review of drugs, focussing on treatment, recovery and prevention, including an assessment of the adequacy of drug and alcohol misuse service funding. The review was published on 8 July and makes 32 recommendations to Government, including increasing levels of funding to drug and alcohol misuse services. The Government is committed to supporting the most vulnerable at risk from alcohol misuse, including through establishing alcohol care teams in hospitals and supporting children of alcohol dependent parents. We will be publishing a new Tobacco Control Plan later this year setting out plans for England to become a smoke-free country by 2030.

It covers the risks of using nitrous oxide, including the risks of mixing it with alcohol. As part of the NHS Long Term Plan, we are supporting acute hospitals to establish or improve specialist Alcohol Care Teams (ACTs) in hospitals with highest rates of alcohol harm. It is estimated that, if implemented in the 25% of hospitals with the highest rates of alcohol-dependence-related admissions, fully optimised ACTs could prevent 50,000 admissions over five years.
