After the brave Assembly protest by Jayne Sullivan over Herceptin, the judgment this morning that a primary care trust was right to deny the drug to a patient, and the Health Secretary's confusing statement that PCTs should not reject prescribing Herceptin for early-stage breast cancer on the ground of cost, will the Minister agree to press his Labour colleagues in the Department of Health and the Assembly to sort out the confusion over the prescribing of the drug because this vital matter affects all breast cancer patients in England and Wales?

Mrs. Gillan: To ask the Secretary of State for the Home Department what investigations have been carried out by his Department on the reliability of the drugs tests currently available. [161181] Caroline Flint: Drug testing technology and its reliability is kept under constant review by the Home Office due to its applicability to roadside impairment testing and its relevance in the workplace. The extent and definition of `reliability' in these different settings is by nature of the criminal law different in each case. Recently there has been research on the reliability of different methods of drug testing carried out by the Forensic Science Service (FSS) for the specific purpose of testing persons in custody suites to see if they have used drugs. The research used saliva as a point-of- contact using the Cozart RapiScanTM electronic test strip reader, one of few commercially available on-site testing kits for oral fluid (saliva). Overall, the results of this study revealed that saliva based testings are not reliable enough to evidence impairment for the purposes of charge for driving while impaired by alcohol or drugs. In the workplace, the requirements of the criminal law do not have to be met and it is up to employers to decide what margin of proof is required to consider action against specific employees. Saliva, urine hair analysis or blood tests may all be sufficiently reliable. The Home Office does provides guidance on the various types of tests available to any companies who seek advice, which suggests that some tests are more reliable than others. In the July 2004, an independent inquiry report on drugs testing in the workplace will review some of the complex and wide reaching issues surrounding drug testing in the workplace including the reliability of different testing devices. The report will be the first attempt to give a full picture of drug testing in the workplace and will include recommendations to government, employers and other relevant bodies.

The first steering group meeting was held on 10 October 2002, then 5 November 2002, 9 December 2002, 27 January 2003, 12 February 2003, 25 March 2003, 29 April 2003, 28 May 2003, 24 June 2003, 22 July 2003, 30 September 2003, 28 October 2003, 25 November 2003 and 27 January 2004. Mrs. Gillan: To ask the Secretary of State for the Home Department how many prison officers failed their annual control and restraint test in the past 12 months; and what their ages were. [152711] Paul Goggins: There is no annual control and restraint test in the Prison Service. Prison establishments are required to maintain an appropriate level of officers trained at basic level control and restraint, and those officers selected to fulfil this requirement all undertake initial and refresher training courses. However, these courses do not include a test. Officers who deal with incidents of concerted indiscipline attend an advanced control and restraint training course. Again, officers are not formally tested at the end of this training. However, to gain admission to the course, an officer must be identified by his or her line manager as having an aptitude for the role; and is required to undertake a fitness test. From 1 January to 31 December 2003, a total of 4,353 officers undertook this fitness test, including officers from private prisons. The overall pass rate was 98.6 per cent, with 62 officers, aged between 18 and 65, failing.
