My Lords, I am sure that the Minister will agree that bringing existing homes up to standard is an important part of the programme of providing housing. He will be aware of the challenge by a number of councils of all political persuasions against the shift out of the decent homes value-for-money budget. Does this not mean that council tenants will be subsidising the programme to a fairly considerable degree? Frankly, that is a rather odd component.

My Lords, as I understand it, the challenges, coming from three Tory councils and one Lib Dem council, are about the deferral of part of the funding that was originally allocated. Let me remind noble Lords that, in 1997, we inherited a massive £19 billion backlog on social housing repairs, with more than 2 million homes failing basic decency standards and too many of society’s most vulnerable on the streets or in bed-and-breakfast accommodation. We have made massive improvements since then, radically transforming people’s homes through 700,000 new kitchens, 525,000 new bathrooms and the rewiring of 740,000 council homes. This has been a success for the decent homes policy, which did not exist before.

My Lords, as I have indicated, this decision is not really about culture or the arts in that sense; it is about a licensing system. Therefore, this is rather a straightforward bureaucratic exercise. Those have been the priorities and the criteria attached to it. However, I am happy, of course, to agree with the noble Baroness that we have a rich distribution of the arts in the United Kingdom, and we should value that.

While it is not directly within his responsibility, will he use his good offices to urge that we become on a par with the Scottish Parliament and Welsh Assembly, which have Changing Places facilities? As he clearly understands that the Question is about profoundly and multiply disabled people who have particular needs, can he tell the House what work the Government are doing to collect data in order to understand what are probably the large numbers of people with such needs?

My Lords, as the noble Baroness identified, the first point is fundamentally a matter for the House authorities. I made inquiries on what provision there was within our buildings. I think that there are no Changing Places facilities; perhaps there are more routine disabled toilet facilities, but probably not enough. So far as data collection is concerned, the discussions that took place last year in relation to the strategy indicated the complexity around all that and the provision that there is generally. Part of it is provided by local authorities and part within commercial facilities, whether supermarkets or pubs. We are not sure that imposing some duty on local authorities in particular to drive the collection of data is the best use of resources and time.

Government can promote changes in the policies and practices of external bodies through a variety of means, such as legislation, the provision of funding information or guidance, by piloting initiatives, and by spreading best practice. The assessment of the best means in any circumstances is carried out on a case by case basis.

Most of the proposals for change in the White Paper Communities in Control do not require legislation. For those where legislation is required, the Local Democracy, Economic Development and Construction Bill, which is currently before Parliament, contains the major provisions, including a number added since introduction.
Given the stage of the parliamentary cycle, we have decided to concentrate our energy on this, and not to publish a Draft Community Empowerment Bill, which would have contained only a few more minor proposals.
Substantial progress has been made since Communities in Control was published. We published a "Communities Progress Report" on 1 June. Copies are in the Libraries of the House.

My Lords, I declare an interest as joint president of London Councils, representing the London boroughs. The Minister will be aware that the shortfall in places for reception-age children over the next five years is predicted to be more than18,000. While the funding that she has announced is extremely welcome, it is a short-term measure. The London boroughs are concerned about the likely postcode lottery, since some authorities will not even be eligible to apply for emergency funding. Will the Minister give us some comfort over the long term by, for instance, relaxing the rules so that loans can be given by central government, to be repaid when property prices have risen and local authorities are able to realise assets and repay them?

My Lords, I reassure the noble Baroness and all those concerned about the provision of school places for reception-age children—and even London Councils agrees—that in September there will be plenty of places available for children starting school. Obviously, with changes in the birth rate, there is a lag between the children being born and when they start school. Local authorities have access to the information about rises in birth rate, so in theory the system should work well to predict increases in birth rate and, therefore, the need for more school places. However—
Excuse me, my Lords. The Government accept that there have been some unpredictable rises in some places, and we are committed to working with local authorities to deal with the issue.

My Lords, statutory responsibility for providing school places rests with local authorities, supported by funding from the Department for Children, Schools and Families. To provide for growth in pupil numbers, the department has allocated more than £1.2 billion to fund extra school places between 2008-09 and 2010-11.

My Lords, I appreciate that the noble Baroness cannot commit to the date of legislation, but she will appreciate that those who are concerned about the problem are also concerned about having to wait until the Queen’s Speech in the autumn and then for new legislation. Will the Government see whether there is current legislation on to which they can add some of these provisions? In the mean time, will they talk to the relevant parties about the pre-action protocol and steps that the courts may or may not take?

My Lords, I cannot pre-empt any legislative vehicle, for the reasons that the noble Baroness gave, but we will certainly find the first relevant legislation that we can. We have to consult properly because this is a complicated situation, as she will know, given her experience. Tenancy agreements are very complicated indeed. We have to work—and we are working—closely with lenders, who have been very supportive on this, as have the lobby groups. We need to improve the current practices when an unauthorised tenant is found in the property. We are working to mitigate the impact on tenants whose landlords are in arrears. For example, in April we extended the period of the possession order to seven weeks, which will help. We will try to get as much information as we can to tenants who may be vulnerable, but the difficulty is in finding them.

The White Paper Communities in Control was published in July 2008. The overall aim is to pass power into the hands of local communities, to generate vibrant local democracy in every part of the country and to give real control over local decisions and services to a wider pool of active citizens.
These reforms require widespread changes in policy and practice by the whole range of public sector agencies, and most do not require legislation. For those proposals where legislation is required, the major provisions are included in the Local Democracy, Economic Development and Construction Bill, which is currently before Parliament. They include the proposed new duty on local authorities to promote democracy, measures to boost the role of petitions in local democracy, an extended duty on public authorities to secure the involvement of persons in their functions, steps to strengthen local authority overview and scrutiny procedures, provisions on local freedoms and honorary titles, and changes to Widdicombe rules on politically restricted posts in local authorities.
Given the scope of this Session's Bill, we have decided not to publish further draft provisions on empowerment for pre-legislative scrutiny during the current Session. We will discuss with key stakeholders how best to take forward any remaining proposals where legislation may be required. In particular, we will consider our response to a recent consultation on Changing Council Governance Arrangements, which raised issues on elected mayors, and will discuss with the National Association of Local Councils how best to take forward proposed reforms to parish governance. We do not currently propose to take forward a number of more minor proposals, namely on remote attendance and voting by councillors, payments for councillors on loss of office, and incentives to vote in local elections.
Substantial progress has been made over the past nine months on major commitments from Communities in Control. We plan to publish a communities progress report soon.

I have made a statement that in my view the provisions of the Bill are compatible with the Convention rights. I am also satisfied that Clause 16 has no adverse effect on any employment or other rights. Clause 16 imposes no new obligations on any officer of any local authority because every officer of every authority operating executive arrangements can already be required to attend before an overview and scrutiny committee and answer questions. The Government do not disclose their legal advice in these circumstances.

If a local authority fails to comply with its legal obligations, petitioners could use the usual public law remedies, such as the authority's complaints procedure, complaining to the local government ombudsman or bringing legal proceedings such as judicial review.

Part 1 of the Local Democracy Economic Development and Construction Bill covers a number of different policy areas, mainly arising from the White Paper Communities in Control. The implementation of Part 1 will be monitored through the management of the wider empowerment programme and our monitoring of delivery against public service agreements including PSA 21, which is concerned with building more cohesive, empowered and active communities. It is not possible to disaggregate the costs of monitoring Bill provisions from the wider empowerment programme management.

Clause 16 of the Local Democracy, Economic Development and Construction Bill provides that local authorities will define for themselves which officers count as "relevant officers" for the purposes of Clause 16(2)(c). The list of relevant officers in each principal local authority must include the senior officers specified in Clause 16(5). The number of officers covered by the provisions of Clause 16 will, therefore, depend on local authorities' own administrative arrangements and decisions.

Neither the drafting of the Local Democracy, Economic Development and Construction Bill nor Ministers’ comments suggest that principal local authorities should feel obliged to interpret "relevant officer" under Clause 16(4) the Local Democracy, Economic Development and Construction Bill as meaning any officer of the authority. It would be open to principal local authorities under Clause 16(4) to specify in their petition scheme that any officer is a "relevant officer". However, the Government do not expect that authorities would choose to specify in their schemes that junior staff are "relevant officers" who would be required to give evidence under Clause 16.

My Lords, the Minister’s departmental website, which I trawled yesterday looking for evidence and research on HIPs, does not show any recent research. I could not find the reference to the independent research that she mentioned. The website did tell me that I could subscribe to Ministers’ "twittering" but that is not entirely helpful in this context. The Government cite the need for an evidence base. What evidence do they have on the effect of requiring a HIP from the first day of marketing, a change to be introduced at the beginning of April, as she mentioned? What difference will that make?

My Lords, over the past year we have been working closely with the industry. The package that we brought forward in December is looking at different forms of simplification and working parties. I can send the noble Baroness a collection of evidence that we have gathered and put forward, but essentially it is counterfactual evidence because the HIPs were not being seen and we were told not least by estate agents and consumer organisations that it was important for buyers and sellers to be able to handle the HIP to make sure that they knew what they were getting for their money and what information it contained.

My Lords, will the Minister congratulate those local authorities that have in mind the need to reduce emissions when they design their car parking policies, such as policies for residents’ parking and on-street parking in controlled parking zones? This makes it less expensive for lower-emitting cars to park. My borough of Richmond has been at the forefront of this.

My Lords, of course we welcome anything that local authorities can contribute. There is no doubt that a whole range of strategies can be deployed to encourage the use of low-pollutant cars. The message of the benefit of low-pollutant cars is probably widespread in the community. We need consumers to act accordingly.

My Lords, the best thing that I can say to local authorities that are concerned, as we all are, about the loss of small shops—about 380,000 small shops fall into the category of below £15,000 rateable value—is that the package that was introduced in the Pre-Budget Report has raised the rateable value for exemptions on empty property rates from £2,200 to £15,000 and we want to make sure that small shops and offices know about that and are claiming that relief. I am grateful to the noble Baroness for pointing out that these changes were introduced in 1990.

My Lords, we rely so much on housing associations to provide social rented homes and it is extremely important that we are as positive, supportive and flexible as possible. We are allowing the HCA limited flexibility to increase levels of grant to housing associations to compensate for the difficulties of negotiating Section 106 agreements, for example. So we are doing something immediate and positive there, which will be linked to an agreed programme of future activity. We are also giving ourselves complete flexibility to switch unsold shared ownership stock to rent and HomeBuy. Those are two very positive actions that will help the RSLs step up to the plate.

A team of four policy officials and two lawyers worked full-time preparing the Bill from July 2008 until introduction in December. The cost of this team for this period is estimated at £108,000. In addition, a significant number of officials have been involved on a range of policy issues, including specialists as part of their regular job functions. Cost estimates for their time are not estimated or collected.
