I thank the Secretary of State for his reply. The intelligence services withheld information from the investigation into the tragedy of the Omagh bombing, and allegations have recently been made about the intelligence services' role in the death of Kieran Doherty in Derry. What further discussions will he have with the Northern Ireland Executive to prevent such things from happening and to facilitate future investigations? He told the Northern Ireland Affairs Committee that it would become more likely that the intelligence services would co-operate, but more likely is not good enough.

I am sure that the House will want to pay tribute to the hon. Gentleman, who has been an assiduous Member of Parliament for 23 years and was a founding member of his party. We wish him well in the future.
I am of course considering the Select Committee's report, but I remind the House that Sir Peter Gibson published his report last year and that after he examined the information available on the day, he concluded that""to the extent that any relevant intelligence was derived from interception, it was shared with RUC…and Special Branch South promptly and fully"."

Could he explain to the House why the Government have abandoned the core agreement principle of inclusivity by excluding 44 per cent. of the electorate from meaningful inter-party dialogue at these talks, and explain the abandonment of proportionality in the allocation of Ministries?

I certainly share the sense of frustration; after eight days and 110 or 120 hours of talks, sleep deprivation might be having its effect, as well.
The Prime Minister and the Taoiseach wanted to ensure that it was possible for the political parties to reach a reasonable agreement. Let us remember that, ultimately, because of the St. Andrews arrangements, the completion of devolution will be decided by a cross-community vote. However, before that, the political parties have been engaging in the past week in talks in an inclusive way. I can only say that, from what I have seen so far of the product of these talks, many of the points that the political parties in Northern Ireland would have wanted to see in such a process are very much under consideration.

The Hillsborough talks established by my right. hon. Friend the Prime Minister and the Taoiseach last week have now continued for eight days. The British and Irish Governments helped to establish a basis and a pathway on which we believed it would be possible for the parties to reach a reasonable agreement. Considerable progress has been made. With good political will, we believe that the parties should soon be able to reach a reasonable agreement.

The Government believe that the time is right for the Northern Ireland Assembly to complete the process of devolution by requesting the transfer of policing and justice powers. However, the actual timing of devolution remains for the Assembly itself to decide upon, as set out in section 4 of the Northern Ireland Act 1998. Progress continues to be made towards the completion of devolution and I believe that the financial package set out by the Prime Minister should enable the parties to move forward with the process.

My right hon. Friend the Prime Minister will be aware that devolution to Northern Ireland has not been completed owing to the absence of the devolution of policing and justice. This issue has now become a political football between the two parties in power, and the situation has been exacerbated by the recent European elections. Will he take a personal new initiative to complete that all-important stage of devolution, which is the prerogative of the whole community in Northern Ireland?

I think that the benefits to Northern Ireland of the devolution of policing and justice will be very considerable indeed. I realise that there are very delicate issues that have to be dealt with, and that there are conversations to be had, but I recognise that progress has been made with the commitment of the major parties to devolution in principle. Talks are now taking place that I hope will yield results, and I hope it will not be long before we complete the process of the devolution of policing and justice under terms that will give security to every community in Northern Ireland.

The historic agreement announced by the First and deputy First Ministers on 18 November sets out the process that will lead to the transfer of policing and justice powers to the Northern Ireland Assembly. The transfer of powers remains subject to agreement within the Assembly and will require cross-community support, as set out in section 4 of the Northern Ireland Act 1998. All Northern Ireland parties will therefore be involved in the Assembly's decisions about which powers should be transferred and when.

It is great that the solution has come from the parties that created the problem in the first place. Notwithstanding that, I hope he agrees that it is most important to the economic welfare of Northern Ireland, which is the kernel of this question, that they quickly work through the business of five months’ government. He has already said that he, the Chancellor and the Prime Minister will do all they can to help the economy, but will he say what additional funding—in particular, for policing—they hope to provide? Also, will he indicate the timetable for the implementation of the agreement made yesterday?

I am grateful for the hon. Gentleman’s help and support, especially through the challenges of the past few months. On his questions regarding funding and the issues facing the Northern Ireland Executive, as I have already said, the Executive will now start to meet again, starting on Thursday. They used to meet fortnightly, but I understand from the First Minister that they will now meet weekly until all the backlog of business has been cleared. I look forward to learning more tomorrow, when the Executive meet, but I understand that there is a number of matters on the timetable other than devolution of policing and justice that will be covered.
On the hon. Gentleman’s question about funding for policing, my right hon. Friends the Prime Minister and the Chancellor have been working extremely closely with me during the past few months to ensure that devolution is allowed to succeed in Northern Ireland, not only in policing and justice, but in every area, to ensure peace and prosperity for every community.

The hon. Gentleman is absolutely right. The devolution of justice and policing will complete the implementation of the St. Andrews agreement. However, a great deal of progress has been made in Northern Ireland, and I pay tribute to the First Minister. It is great news that the Queen is able to visit Northern Ireland in the next few days; and the conference on investment in Northern Ireland will be held in the next few weeks, with, I hope, substantial American participation. I also hope that all parties will follow the report produced for the Northern Ireland Assembly on the issues that are yet to be resolved in justice and policing, and move forward to reach agreement on those matters quickly.

I am giving further consideration to representations from all the parties, including the hon. Gentleman’s, on the proposal for a committee to prepare for restored government. I am listening carefully to what people are saying, and there is a case for it. I know that he will understand that the proposal made by Sir Reg Empey of the Ulster Unionist party is not a model that I favour and that it has not found favour with the other parties. We must continue the consultations until I am in a position to move forward.

Does he not agree that that would encourage the parties to participate and that their failure to do so would be a rejection of their mandate and, in a sense, an illustration of the fact that they are putting party before people?

I understand the point that hon. Gentleman makes, but he has not persuaded, nor has his party, any other party to support that proposition. I do not think that it is a question of giving any particular assurance to individual parties. It is a question of finding the best way forward for the future of the PSNI, carrying into effect the recommendations of the Patten report. The recent report of the oversight commissioner showed that some two thirds of those recommendations have been successfully carried out and implemented. That shows that the PSNI is not only making tremendous progress in normalising policing in Northern Ireland—I pay tribute to the Chief Constable—but in some respects becoming an example for other parts of the world that have had conflicts. As we move forward on the Policing Board, we need to do so sensibly. I am certainly consulting all parties, including the hon. Gentleman's, which plays such an important role and continues to do so.

The Secretary of State has said in public that all democratic and political progress in Northern Ireland depends on a statement from the army council of the IRA, and that that statement must be acceptable and represent no hindrance to political progress. How would the right hon. Gentleman define the acceptability of such a statement in respect of decommissioning and the cessation of criminal activity and operational capacity? Is he not concerned that such a statement would allow groups such as Sinn Fein to participate in policing and other institutions of law and order? Does he accept that a very close analysis of such a statement would have to be made to ensure that it contained no potential blocks to political progress?

My hon. Friend has put that question very well, and I pay tribute to the role of the Social Democratic and Labour party in the peace process over very many years. It has shown tremendous courage and vision, for which it has not necessarily received credit or recognition at the ballot box. History will show that the SDLP's courage and leadership have been vital components in establishing an unparalleled period of prosperity, stability and political progress in Northern Ireland.

Mr. McGrady: To ask the Secretary of State for Northern Ireland what further progress has been made towards the implementation of
outstanding elements of the Good Friday Agreement. [89178]
Mr. Paul Murphy: Substantial progress has been made in implementing the Agreement, but the restoration of the devolved institutions
depends on the restoration of public trust in the commitment of participants to exclusively peaceful means and to stable inclusive
institutions. If that can be achieved then, as my right hon. Friend the Prime Minister has explained, we can implement the rest of
the Agreement in its entirety together.
