Mr. Sawford: To ask the Secretary of State for the Home Department what plans he has (i) to issue a code of practice as required in accordance with section 101 of Part III of the Police Act 1997 and (ii) to make an order under section 96 of the Police Act 1997 specifying the requirements for notifying a commissioner of authorisations, renewals and cancellations of authorisations. [60673] Mr. Straw: Part III of the Police Act 1997 provides for a statutorily based system of authorisation for intrusive surveillance operations carried out by the police, the National Criminal Intelligence Service, the National Crime Squad and Her majesty's Customs and Excise. As required by section 101 of the Act, before the provisions can be implemented, Parliament must approve an order bringing into force a code of practice for those carrying out functions under the Act. A public consultation exercise on the draft code of practice was carried out last year. Copies of the draft code were sent to over 500 individuals and organisations and 120 additional copies were provided in response to subsequent requests. By the end of the consultation period, 60 responses had been received. I have considered these representations very carefully, seeking to achieve a balance between the operational needs of law enforcement agencies in tackling serious crime and, at the same time, ensuring that adequate safeguards are in place to protect members of the public from unnecessary invasion of their privacy. As a result, I have made a number of changes to the text of the code. In particular: there is specific reference to the confidential and sensitive nature of information relating to healthcare, counselling and legally privileged material; emphasis is given to the importance of considering the effects of collateral intrusion on those who are not the targets of the authorisation; further guidance is provided on when the urgency provisions should be used; there is reference to the procedures for ensuring effective control on the handling, storage, processing and destruction of the surveillance product, especially sensitive and confidential material; the code now includes an undertaking given by the law enforcement agencies covered by these provisions in relation to spiritual counselling; and the requirements for notifications of authorisations, renewals and cancellations have been further refined. With the appointment of the Chief Surveillance Commissioner and Commissioners, we are now in a position to implement the provisions of Part III, of the Act. I have, therefore, today laid before Parliament a revised draft code of practice. I intend to bring this document into effect, together with the notification requirements required under section 96 of the Police Act 1997, as soon as practicable. I will seek approval of these Orders by resolution of both Houses of Parliament shortly.

Mr. Wigley: To ask the Secretary of State for the Environment, Transport and the Regions when he expects to implement the recommendations of the Review of Byelaw powers for the Coast, drawn up by the Interdepartmental Working Party; and if he will make a statement on his policy with regard to establishing controls over the use of jet-skis and other personal powered water craft. [59377] Ms Glenda Jackson: On 7 October, at the official launch of the Maritime and Coastguard Agency (MCA), I announced the Government's continuing commitment to improve the safety and management of recreational craft through a three-strand strategy. First, safety education initiatives will continue to be pursued by the MCA. Second, and importantly, the MCA will develop a Code of Conduct for all types of recreational craft, including personal watercraft (for example "Jetskis") which will cover best and safe practice together with a voluntary registration and identification scheme. The Code will be developed by the Sea Safety Liaison Group which, in addition to the MCA, comprises representatives of the Royal National Lifeboat Institution, Royal Yachting Association, Royal Life Saving Society UK and the British Marine Industries Federation, and will be subject to external consultation before being launched next summer. The third strand of the Government's strategy is a long term commitment to primary legislation to enable local authorities to have better control, through byelaws, of their coastal waters. This commitment follows acceptance of the recommendations of the review of coastal byelaws by an Inter-Departmental working party led by the Countryside Division of my Department. Following extensive consultation, the working party recommended that: (a) that local authority powers need to be consolidated in one place, and updated; (b) any powers must include the ability to provide exclusive bathing zones where all type of craft, powered and non-powered, can be excluded; (c) local authorities should be given more general byelaw powers (with safeguards to prevent indiscriminate use) to regulate activities affecting the wider environment, and; (d) any extension of, or amendment to, byelaw powers should not conflict or overlap with powers held by other authorities. Having consulted Ministerial colleagues, I have decided to accept these recommendations. The Government intend to pursue the primary legislation needed to bring them into effect in due course. Copies of the Working Party's report "Review of Byelaw Powers for the Coast", are available and have been deposited in the House Library. Taken together, I believe this strategy will do a great deal to improve the safety and enjoyment of the ever increasing numbers of people who use our coasts for recreation.
