Mr. Tynan: To ask the Secretary of State for Environment, Food and Rural Affairs how many (a) reported cases of and (b) successful prosecutions for breaches of maximum residue levels from pesticides there have been in each of the last five years. [197581] Alun Michael: The UK's surveillance programme for pesticide residues in food is overseen by the independent Pesticide Residues Committee (PRC). In 2003, 4,071 samples of imported or UK-produced food were tested for up to 149 different pesticide residues. The Maximum Residue Level (MRL) was exceeded in 27 (0.7 per cent.) samples. For previous years, the percentage of exceedances is similar, at around 1 per cent. All the results are available on the PRC's website at www.prc.org. MRLs are not safety limits. Statutory Maximum Residue Levels (MRLs) have been established for many thousands of individual pesticides in individual crops. The purpose of MRLs is to regulate trade in treated food. They indicate that any pesticide was applied to crops or foodstuffs in accordance with the conditions of use set by the UK regulator, the Pesticides Safety Directorate, or equivalent organisations overseas. They are always set below, often far below, safety limits. The safety limit depends on many factors, which include the properties of the pesticide, the amount of residue, amount of food being consumed and whether this is in a single meal or over a longer period, and the body weight of the consumer (e.g. adult, child, infant). In all cases where an MRL is exceeded, a risk assessment is carried out. The conclusion was that none of the exceedances in 2003 was likely to be of concern for consumer health. Where there is evidence of repeated exceedances of an MRL or the use of a pesticide on a crop for which the pesticide is not approved, a targeted enforcement campaign is carried out. An enforcement campaign has been carried out for the last three years testing for MRL's on winter lettuce. Winter lettuce grown in the UK under glass is particularly prone to fungal attack during the cool damp winter months and there are only a limited number of products approved for disease control. Over the last three years, the enforcement campaign has revealed that there have been 57 samples of lettuce containing pesticide residues over the MRL. This is made up of; 27 samples (18 per cent. of the total samples taken) in 2001-02, 16 (10.8 per cent.) in 2002-03, and 14 (8.7 per cent.) in 2003-04. Although a number of enforcement actions have been taken including warning letters, educational visits and the issuing of enforcement notices, the evidence obtained (and in particular the risk to human health), has not supported any prosecution.

Mr. Tyler: To ask the Secretary of State for Environment, Food and Rural Affairs when she expects to publish the report of the epidemiological study of organophosphate victims by the London School of Hygiene and Tropical Medicine commissioned by her Department; and if she will make a statement. [191318] Mr. Bradshaw: [holding answer 18 October 2004]: The hon. Member for North Cornwall is aware that the London School for Hygiene and Tropical Medicine was contracted to carry out this study and to submit its draft final report for this work in August 2003. As described in my answer to the hon. Member's previous question, given on 20 July 2004, Official Report, column 124W, we received a preliminary draft report of the findings from this study on 13 July 2004. As is usual before publication of any scientific report, this was submitted to a panel of independent experts for peer review. Comments received from this panel were forwarded to the London School of Hygiene and Tropical Medicine (LSHTM) on 21 September 2004. The LSHTM has been invited to consider and respond to the issues raised and to address them in its final report. We hope that this process will be complete by the end of October. Once we are in receipt of this final report, and are satisfied that it adequately addresses the issues raised by the independent peer reviewers, we will publish it without delay. Separate to the peer review process, we understand that Professor Kerry Mills from King's College Hospital has recently met with the contractors to begin his assessment of the validity of the clinical phase of the study. We will be guided by Professor Mills' advice on whether the clinical study should be fully audited before it is published. However, depending on the time scale of this process, we may need to publish the clinical study separately.

Mr. Drew: To ask the Secretary of State for Environment, Food and Rural Affairs if she will list the cases of human pesticide poisoning mentioned by the right hon. Member for Cardiff, South and Penarth (Alun Michael) in his broadcast comments on Farming Today of 17 June; in each case (a) who was the investigating agency and (b) what information from medical practitioners was obtained; and whose conclusion it was that illness was found not to be due to the effects of pesticides. [184435] Alun Michael: It would be quite wrong for me to release the individual case details of the 60 incidents referred to in my broadcast. They were investigated by the Field Operations Directorate of the Health and Safety Executive (HSE) and detail of individual incidents is presented to the Advisory Committee on Pesticides to inform the pesticides approvals process. Cases of alleged ill health caused by the use of a pesticide are investigated by the HSE or the Local Authorities. Reports are then submitted to the Pesticide Incidents Appraisal Panel (PIAP) for their assessment. The membership of PIAP includes medical practitioners and a representative from the Department of Health. PIAP considers individual incident and case reports to identify if there is a link between exposure and ill health which may indicate a trend to inform the regulatory system. Medical records are only obtained from GPs and hospital doctors with the consent of the subject. PIAP considers clinical information as it is recorded in medical files.
