The UK supports the Government of Iraq's efforts to resolve the file on Kuwait and third-country nationals pursuant to UN Security Council resolution 2107. We welcome continued bilateral dialogue between the Governments of Iraq and Kuwait in progressing this issue.

We assess that ongoing dialogue with all Middle East countries and partners remains critical for protecting security and stability in the region. We welcome any measures that serve to improve that dialogue and reduce tensions. We are concerned by the general risks of unintended escalation, which would not be in any party’s interests. We are in touch with our key partners and advising Iran not to take any escalatory steps.

To ask Her Majesty's Government, further to the Written Answers by Lord Ahmad of Wimbledon on 14 March (HL5931, HL5932 and HL5933), what progress has been made in assessing the capacity of the Iraqi courts to prosecute Daesh in pursuance of UN Security Council Resolution 2379.
To ask Her Majesty's Government, further to the Written Answers by Lord Ahmad of Wimbledon on 14 March (HL5931, HL5932 and HL5933), what progress has been made in assessing the capacity of the Iraqi courts to prosecute Daesh in pursuance of UN Security Council Resolution 2379.
The UN will soon deploy a Needs Assessment Mission to Iraq to assess capacity building needs and advise where Member States and the UN should target their support. We look forward to the UN reporting on their findings. The UK is also working directly with the Iraqi judiciary to build their capacity, as called upon by UN Security Council Resolution 2379. A Special Advisor, Karim Khan QC, has been appointed to lead the UN Investigative Team established by the Resolution. The Special Adviser will deploy with the Investigative Team to Iraq to gather evidence and support the work of the Iraqi judiciary.

Following the adoption of UN Security Council Resolution 2379, the Terms of Reference for the UN Investigative Team have been agreed. A team from the UN Office of Legal Affairs visited Iraq in early April to meet key Iraqi stakeholders, and we expect the Special Advisor who will lead the investigative team to be appointed very soon. Once this appointment has been made, the investigative team will be recruited by the Special Advisor and deployed to Iraq. A trust fund has been established to help joint fund the team alongside funding from the UN's Regular Budget. The UK has contributed an initial £1 million. We are also working with the Iraqi judiciary to build their capacity, as called upon by the Resolution.

Daesh must be held accountable for their crimes. Daesh fighters – regardless of their nationality – should be brought to justice according to legal due process.
The Investigative Team established under UN Security Council Resolution 2379 will gather evidence of Daesh crimes, beginning in Iraq. The Terms of Reference for the UN Investigative Team have been agreed and I look forward to its deployment. The UK has contributed £1 million to support the establishment of this team. We are encouraging other States to contribute to it. The UK is funding a project that builds Iraqi organisations' capacity to document and present evidence of gender-based violence.
The Investigative Team will collect evidence of acts that may amount to war crimes, crimes against humanity and genocide to the highest standards and ensure the broadest possible use of evidence. Iraq will be the primary intended recipient of the evidence, but it can be used to support prosecutions elsewhere. It may be that some form of international or hybrid justice mechanism may be appropriate in the future, but it is too early – and not for the UK alone – to pre-determine that.
We are working with the Iraqi judiciary to build their capacity. The Resolution calls on member states to provide similar support. The UN will soon deploy a 'Needs Assessment Mission' to Iraq to determine where member states and the UN should target their capacity building.

We are working closely with the Government of Iraq to bring Daesh to justice. The UK continues to work with the High Judicial Council and Counter-Terrorism Investigative Judges to assess the current capability of the Iraqi judiciary, including on human-rights compliance. Most recently the Attorney General met the Chief Justice of Iraq on his visit to the UK in October, where they discussed the importance of holding Daesh to account through the courts. We have identified areas where we can share expertise and will continue to work closely with the Iraqi Judiciary to ensure due process and compliance with international law.
