Mr. John M. Taylor: The Department sets out the following age requirements in primary legislation:
Under the Explosives Act 1875, sections 31 and 39, it is an offence to sell gunpowder and other explosives, including fireworks to
any person apparently under the age of 16.
Under the Consumer Credit Act 1974, section 50, it is an offence to send, with a view to financial gain, any document inviting a
minor--a person under the age of 18--to borrow money, obtain goods on credit or hire, obtain services on credit or apply for
information or advice on borrowing money for otherwise obtaining credit for hiring goods.
Under the Employment Rights Act 1996, section 211, for the purposes of a redundancy payment, no period of employment counts until
the employee has attained the age of 18.

Mr. Horam: This Department sets out the following age requirements in primary legislation:
under the Children and Young Persons Act 1933, section 18, children may not in general be employed under the age of 13. Restrictions
also apply to hours worked by children up to the minimum school leaving age. Street trading under the age of 16 is also prohibited
under section 20 of the Act as amended, but children of 14 or over can be employed by their parents. These requirements are enforced
by local authorities; and
an application for a licence to set up a nurses agency may be refused by a local authority under section 2(3)(a) of the Nurses
Agencies Act 1957 if the applicant, or licence holder, is under 21.

Legislation Minimum age requirement
Agricultural Wages Act 1948 19 years for adult rate of pay; 18 years for flexible working
contract; 19 years for higher rates of pay depending on
qualifications.
Control of Pesticides Regulations 1986 (as amended) Anyone using an agricultural pesticide is required to hold a
certificate of competence unless they were born on or before 31
December 1964; or are using it under the direct personal
supervision of a person who holds such a certificate; are
applying the pesticide on their own land or land belonging to
their employer; or the pesticide is being used for a
non-agricultural purpose.
Schedule 1 to the Welfare of Animals (Slaughter or Killing) Licensing of slaughtermen: 18 years for applicants for either a
Regulations 1995 certificate of competence (required to be presented with an
application for a registered licence) or a provisional licence
(Regulation 4(3), Sections 4(2)(c) and 7(1)(b) respectively
refer).
Veterinary Surgeons Act 1996, Schedule 3 Allows exemptions from restrictions on the practice of
veterinary surgery by: persons under 17 years old undergoing
instruction in animal husbandry, provided the instruction is
given by a registered veterinary surgeon and at a recognised
institution unqualified people aged 18 or over carrying out
specified minor operations.

Mr. Robin Squire: The Department for Education and Employment is not in general responsible for enforcing age requirements. However,
age requirements do apply to certain education, training and employment measures, including the following:
Children must be aged four to be eligible for the nursery voucher scheme.
The majority of places offered under the assisted places scheme begin at age 11. From September 1996, places are now available for
the first time for primary age children as young as five. Assisted sixth form places are also available.
Current regulations require pupils to remain at school until one of two dates: for pupils whose birthday falls between 1 September
to 31 January, it is the end of the spring term--that is, the Easter holidays--following their 16th birthday; for those whose 16th
birthday falls between 1 February to 31 August, it is the Friday before the last Monday in May. The only exception to the above is
for those children who have not been registered at a school at any time during the year preceding their 16 birthday. For these
children the upper limit of compulsory school age is their 16 birthday.
For programmes covered by the training and enterprise councils operating agreement, and other associated contractual documentation:
young people have to have reached the minimum school leaving age (as above) before they can join youth programmes;
people need to be 18 before they are eligible for training for work;
pupils are eligible to take part in work experience if they are in the last term of year 10 or year 11;
children of school age are eligible to use the child care services provided by the out-of school childcare grant.
To receive income-based jobseeker's allowance, claimants must have reached the age of 18; 16 and 17-year-olds may receive JSA.
However, if they are in circumstances prescribed in the Jobseeker's Allowance Regulations 1996--regulations 59, 60 and 61--or if the
Secretary of State decides they would suffer severe hardship unless an allowance was paid. In either case, 16 and 17-year-olds must
meet the basic requirement conditions for JSA.
The teachers' superannuation regulations impose minimum age requirements in four areas:
membership of the scheme--age 18;
purchase of added years--age 20;
retirement on age grounds--age 60;
premature retirement--age 50.

Mr. Streeter: The statutory minimum age requirements enforced by the Lord Chancellor's Departments and the agencies for which the
Lord Chancellor has ministerial responsibility are as follows.
Individuals under the age of 18 cannot act on their own behalf as plaintiffs. Proceedings are issued through a next friend or
guardian ad litem. This applies in all cases unless the claim is being made for the recovery of wages-- County Courts Act 1984,
section 47. In those circumstances, minors can act for themselves.
An individual under the age of 18 cannot act on his or her own behalf as a defendant in civil proceedings. This applies in all cases
save where the claim is for a liquidated amount and permission has been granted by the court allowing the minor to act for him or
herself.
Jurors qualify for jury service if they are at least 18-years-old on the day jury service is to start.

Sir Paul Beresford: Specific measures to protect the health and safety of young people and the relevant minimum age requirements are
listed in annex 3 of the Health and Safety Commission's consultative document, "The Health and Safety (Young Persons) Regulations
1996: Proposals to implement the health and safety provisions of the EC Directive on the protection of young people at work". Copies
of this document have been placed in the House of Commons Library. No other part of my Department is responsible for enforcing
minimum age requirements.

to fish in the Minquiers. [7764]
Mr. Sackville: The waters around the Minquiers form part of the territorial sea of Jersey. The Sea Fisheries (Jersey) Law 1994
permits continued fishing by French vessels in this area, in conformity with long-standing agreements between the British and French
Governments.

Mr. Barry Field: To ask the Minister of Agriculture, Fisheries and Food under what statutory provision the United Kingdom is
permitted to suspend concessions for French fishermen fishing in United Kingdom waters. [7790]
Mr. Baldry: The rights of access of French fishing vessels to fish in United Kingdom waters are contained in Council regulation
(EEC) No. 3760/92. Article 6 and annex 1 of this regulation set out particular access rights in the coastal waters of the United
Kingdom between six and 12 miles. These access rights are given statutory effect in the Fishing Boat (European Economic Community)
Designation Order 1983, as amended. They could not be unilaterally suspended without the United Kingdom being in breach of its
international obligations.
