Mr. David Martin: To ask the Secretary of State for Defence when he expects to place a contract for batch 2 Trafalgar class
submarines; and if he will make a statement. [20655]
Mr. Arbuthnot: I am pleased to announce that a contract has been placed with GEC-Marconi as prime contractors for the design, build
and initial support of three batch 2 Trafalgar class submarines. The new boats will be known as the Astute class, and are expected
to enter service early next century. The submarines will be built at GEC-Marconi's VSEL shipyard in Barrow.
The new vessels will be powered by the Rolls Royce PWR2 nuclear reactor, fitted with the updated weapons system of batch 1 Trafalgar
class submarines, and armed with the Spearfish torpedo and Submarine-Harpoon anti-ship missile. They will be able to carry
conventionally armed Tomahawk cruise missiles. The Astute class will replace the Royal Navy's existing Swiftsure class boats as
these vessels reach the end of their operational lives in the early part of the next century. They will perform a wide range of
roles including anti-submarine and anti-surface warfare.
The order was won in competition with VSEL, before the company was taken over by GEC-Marconi, and the decision was based on what
would provide the best value for money for the taxpayer. The contract will be worth nearly £2 billion to GEC-Marconi and its
sub-contractors, and will help to sustain around 7,000 jobs. It has been warmly welcomed by the Royal Navy, and is good news for
Barrow and the many sub-contractors who will be working on the project across the UK.

Mr. David Martin: To ask the Secretary of State for the Environment if he has considered the responses to the consultation paper he
issued in July on the Producer Responsibility (Packaging Waste) Regulations; and if he will make a statement. [10475]
Mr. Gummer: Together with my colleagues the President of the Board of Trade, and the Secretaries of State for Scotland and for
Wales, I published proposals in July which aim to secure an effective business led approach to meeting the environmental goal of a
more sustainable approach to packaging waste. This followed a lengthy process of consultation with a wide range of business sectors
and is based on the industry agreement on the shared approach achieved on 15 December 1995.
The system we propose is based on four guiding principles:
using the market to reflect the cost of dealing with waste in the price the consumer pays;
a shared approach involving all parts of the packaging chain;
the lightest regulatory approach giving the maximum scope for obligated businesses to self-certify and self-assess their obligations
and to perform those obligations through business run schemes, or individually subject to monitoring by the environment agencies.
continuing industry involvement in monitoring, reviewing and proposing changes to the system through the Advisory Committee on
Packaging.
We have had a wide range of responses to the consultation paper including 100 from trade associations representing 53,000 member
businesses and a further 348 from individual businesses and, other interested organisations. Most respondents endorsed the overall
framework and the basic provisions which flow from the 15 December agreement. However, the responses did raise specific concerns on
issues such as timetable, the level of interim targets, the cut-off threshold for small businesses, the wholesaler obligation and
the scope and nature of exemptions. I have considered these and have sought the views of Sir Peter Parker and the Advisory Committee
for Packaging and I am grateful to have their further comments which will be published separately.
I therefore intend to make the following modifications to the draft regulations which will be subject to parliamentary debate.
To allow businesses sufficient time to assess the implications of the regulations for them and the merits of joining a collective
business scheme such as VALPAK, I propose to delay the first requirement for registration and provision of data until the summer of
1997 and I will make a further announcement shortly. The date for the renewal of registration and the provision of data will, from
1998 onwards, be 1 April.
A further concern raised related to the proposed interim targets for recovery and recycling which could place an unnecessarily high
burden on some businesses and particularly on those who handle materials which are harder to recover. Many felt that a slower
build-up to the full directive targets in 2001 targets would be more realistic. I therefore propose to revise the interim targets on
individual businesses as follows:

These targets will enable the UK to meet the recycling and recovery targets set out in the EC directive on packaging and packaging
waste, 94/62 EC.
I have also taken account of the representations that some sectors of industry will have greater difficulty in adapting to the
proposed obligations than others, particularly in the case of small firms. I also consider that the most effective means of
introducing the new system will be to take a staged approach starting with the largest businesses. I therefore propose to adopt a
phased approach in relation to the following aspects: No business with a turnover of less than £5 million, or that handled less than
50 tonnes of packaging will have an obligation in the years 1997 to 1999, but from 1 January 2000 an eligible business with a
turnover of £1 million or more and that handled more than 50 tonnes of packaging will be obligated. The proposed wholesaler
obligation will apply from 1 January 2000.
I am confident that a phased approach will allow these sectors additional time to prepare and work up methods for meeting recycling
and recovery objectives in a form which meets their needs.
I have considered also issues raised by those who handle packaging which is or is associated with special or hazardous waste. Where
packaging is likely to become special waste, producers will not need to include it when calculating their recovery and recycling
obligations, but they will need to provide data and indicate the steps taken to promote or increase its recovery. This amendment
should assist those producers that handle packaging whose hazardous or contaminated nature require special disposal arrangements.
I also propose to place an obligation on production of reusable packaging but to exempt it when it is reused. Other more detailed
changes will be set out in the published regulations.
I also recognise that for many businesses a major concern is not the recycling and recovery effort itself but the means of gathering
data. Some businesses already have good data systems while many trade associations and the Industry Council on Packaging and the
Environment are already working to develop sector guides and assistance with definitions and other guidance. I intend to support
this work and to make available, to help to start the system, a very simple ready reckoner which businesses can use to meet the
initial requirement for a best estimate expressed in tonnes per annum.
The environment agencies who will monitor and enforce the regulations will charge a fee to individual businesses and collective
schemes to cover the costs of their functions. In the light of consultation, and taking account of the changes listed above I
purpose to set the fee for individual businesses at £750 per annum and to offer schemes a rebate of up to 87 per cent. of this
according to the size of their membership.
The advisory committee is continuing its work on implementation of the system and is currently considering matters relating to
evidence of compliance and recent representations it has received on the issue of equitable participation in household waste
recovery. It is also preparing for its review of the system as a whole. On these and other issues, it will publish its findings as
appropriate and I am fully committed to supporting its continuing role.

Mr. Gummer: Under current legislation, if a building or part of a building, such as a granny annex, is a self-contained unit of
living accommodation, then it is assessed for council tax purposes as a separate dwelling.
In some circumstances, this means that families whose dependent relatives live with them may face two council tax bills, one for
each part of their property.
My right hon. Friend the Secretary of State for Wales and I now propose to amend these rules, so that in future a self-contained
unit within a single property will not be treated as a separate dwelling if it is occupied by an elderly or disabled member of the
family living in the rest of the property. This will relieve the burden which presently falls on some families who have chosen to
provide support for close family members under the same roof with a measure of independence.

Mr. David Martin: To ask the Secretary of State for the Environment what progress has been made in respect of the system of local
air pollution control which was established under part I of the Environmental Protection Act 1990. [8338]
Mr. Clappison: The Government have today published a progress report on the implementation of the system of local air pollution
control which was established under the Environmental Protection Act 1990.
The local air pollution control system specifies processes which are not to be operated without an authorisation from the relevant
local authority. One of the main objectives of the system is to reduce industrial emissions and to improve local air quality.
The report show that, since 1991, business has submitted some 15,000 applications for authorisation. Local authorities have decided
92 per cent. of all applications. This is a considerable achievement, given the task which local authorities faced, not least in
familiarising themselves with new legislation, procedure and technical information.
The report also highlights the important role local air pollution control will play in the successful development of the new system
of local air quality management, which was established under the Environment Act 1995.
Local air pollution control should result in substantial improvements in air quality in locations where industry has been a
significant air pollution source, helping us to achieve air quality targets and commitments.
For example, a large number of industrial emitters of volatile organic compounds fall within local air pollution control. The
Government's strategy to secure a 30 per cent. reduction in annual volatile organic compound emissions between 1988 and 1999 places
considerable reliance on the reductions in emissions of volatile organic compounds which will result from local air pollution
control. Present indications are that, by 1999, the reduction may be of the order of 40 per cent. reflecting a significant
contribution by local air pollution control.
One reason for the success of local air pollution control has been the adoption of a partnership approach. Central and local
government, business as and wider interests have been actively involved in the development of both policies and procedures.
Whilst local air pollution control now appears to be firmly established and is operating effectively, the next five years will
involve new challenges, including a substantial amount of upgrading of existing processes over the next two years. The report, which
we have published today, will help to develop a clear view of the issues which face local air pollution control in the next few
years and the priorities which should guide its development.
I have arranged for a copy of the report to be placed in the Library of the House.

Mr. Portillo: The Challenger 2 development programme was successfully completed, with all reliability targets achieved on
development tanks. Following a series of trials on early production tanks we identified a need to improve the reliability of some of
the elements of production vehicles to meet the very high standards set. An agreed programme to achieve this is being undertaken by
the contractor, Vickers plc, at no additional cost to my Department. Central to the programme is a sequence of production
reliability growth trials with agreed technical milestones.
The company has met the requirements set in the first of those trials, which was held in July. Challenger 2 has already demonstrated
an impressive capability. I am confident that Challenger 2 will fully meet all our technical and reliability requirements in 1997.
In order to ensure that the comprehensive logistic support arrangements that we require are properly established, I have agreed that
the in-service date for Challenger 2 will be June 1998.

Mr. Gummer: The Government will issue for consultation on 21 October draft regulations for the protection of important hedgerows in
England and Wales, under section 97 of the Environment Act 1995. The regulations are to be introduced jointly by the Secretary of
State for the Environment, the Minister of Agriculture, Fisheries and Food and the Secretary of State for Wales.
The Government are keen, during this consultation, to hear from a wide range of people and organisations that may be affected by, or
have an interest in, these proposals--before the detailed arrangements are finalised.
The criteria for determining whether a hedgerow is important are based on a study undertaken by ADAS to develop a hedgerow
evaluation system. The report will be published at the same time as the draft regulations.
Copies of the draft regulations and ADAS report will be placed in the House Library.

Mr. Gummer: I indicated in my written reply to my hon. Friend the Member for Hexham (Mr. Atkinson) on 9 January 1996, Official
Report, column 7, that further candidate special areas of conservation would be sent to the European Commission once points raised
in public consultation had been considered and satisfactorily resolved. A further list of 44 sites was sent to the Commission on 14
October.

Mr. David Martin: To ask the Secretary of State for Defence what plans he has to improve the capability of the joint rapid
deployment force.[38804]
Mr. Portillo: The Government are committed to the joint rapid deployment force which will become operational on 1 August. Our
amphibious capability will play a key role in that force: the Royal Marines' ability to mount amphibious operations is critically
dependent on the landing platform docks, currently HMS Fearless and HMS Intrepid. Both vessels have given long and distinguished
service, including in the Falklands campaign, but will soon be approaching the end of their operational lives. I am pleased,
therefore, to be able to announce that I am today placing a contract with GEC Marine to design and build two replacement ships at
the Vickers Shipbuilding and Engineering Ltd. shipyard at Barrow-in-Furness. The new LPDs will be called HMS Albion and HMS Bulwark.
They displace 13,000 tonnes, have a maximum speed of 18 knots and have a crew of just over 320. They can carry up to 650 troops, a
range of vehicles, including tanks, and eight landing craft. They also have a flight deck that can accommodate two EH101 helicopters
or one Chinook. They are expected to enter service early in the next decade. This order will be warmly welcomed by the Royal Navy
and will also be good news for Barrow and for the many subcontractors throughout the UK, providing weapons systems, marine
equipments and other components for the ships. The order, worth more than £450 million to GEC Marine and its sub-contractors, will
help to sustain some 2,000 jobs in the UK.

Mr. David Martin: To ask the Secretary of State for Foreign and Commonwealth Affairs when the annual report of the Westminster
Foundation for Democracy will be available.[38625]
Sir Nicholas Bonsor: Copies of the foundation's annual report for 1995-96 will be placed in the Libraries of the House during the
week beginning 22 July. The foundation received £2.5 million from the FCO for its activities in 1995-96. With this grant it has
supported 426 projects, compared with 244 last year. Its priority areas for assistance have been central and eastern Europe, central
Asia and anglophone Africa, but it has also funded projects elsewhere. The foundation continues to make a valuable contribution to
the promotion of democracy overseas. Projects have included work with political parties, the independent media, trade unions, human
rights groups, women's group and other non-governmental organisations involved in political development.

Mr. David Martin: To ask the Secretary of State for National Heritage what deregulation orders her Department has made under
sections 1 to 4 of the Deregulation and Contracting Out Act 1994.[38770]
Mr. Sproat: The Department's first Deregulation Order was made on 16 July 1996 and will come into force on 16 August 1996. It
abolishes the existing statutory requirements for television dealers both to register with the BBC and to hold and pay a fee for a
dealer demonstration licence. Dealers will still be required to notify all sales or rentals of television sets to the BBC.
