To ask the Secretary of State for Housing, Communities and Local Government, what technical or planning criteria he will consider before granting a hyperscale data centre project a Development Consent Order via the Nationally Significant Infrastructure Project (NSIP) regime.
Any decision to grant a Development Consent Order will take into account matters raised at Examination, and the recommendation report of the Examining Authority.
As a business and commercial project, a data centre would first need to be directed into the Nationally Significant Infrastructure Project (NSIP) regime by the Secretary of State under section 35 of the Planning Act 2008 which sets out the legal tests which must be met in order for the Secretary of State to make such a direction. An application for a direction to be made under section 35 must demonstrate the proposed development complies with the criteria set out in the (then DCLG) Policy Statement of 4 November 2013, which can be found on here.
The Department for Science, Innovation and Technology will shortly issue a new National Policy Statement for data centres. This will set out the national policy for this sector and the policy framework for decision-making in respect of data centres.

To support funding of the Government's Defence Investment Plan, it was announced the Department will consult on the potential cancellation of two schemes; A38 Derby Junctions and A46 Newark Bypass, both of which have been granted development consent orders. No final decision will be taken until after the consultation exercise has taken place.

The Environment Agency is progressing the River Thames Scheme following the reset, with an updated Outline Business Case which will be submitted in summer 2026. The programme timeline for the Development Consent Order and Construction phases will be agreed as part of the assurance of the Business Case.

Since 5 July 2024, four road schemes with an extant Development Consent Order have been cancelled on affordability and/or value-for-money grounds.
Figures for the A303 Stonehenge Tunnel and A1 Morpeth to Ellingham dualling were published in the National Highways’ Annual Report and Accounts 2025, along with a provisional figure for the A12 Chelmsford to A120 widening and A47 Wansford to Sutton dualling schemes.
Final exact costs for the A12 and A47 will be published in the 2026 Accounts.

The application for development consent was assessed in the usual way against all relevant planning considerations. An extension to the deadline for deciding the application was announced on 14 May by written ministerial statement to Parliament. It would not be appropriate to comment further while the case remains live.

In line with Treasury guidance, the development of the Business Case for East West Rail will progress as East West Rail Company continues to develop and refine the project.
The Full Business Case will be submitted for approval and then published, once planning consent has been secured, which is standard for this type of project.

The Secretary of State has not held discussions with National Grid Electricity Transmission on the siting of new substations or the consenting process of renewable projects.
In his quasi-judicial role in determining Nationally Significant Infrastructure Project (NSIP) applications for Development Consent Orders, he cannot comment on the merits of projects to avoid prejudicing the decision-making process.
Network developers are responsible for determining the siting of new substations in line with relevant national policy, including the National Policy Statement for electricity networks (NPS EN-5).
The Planning Act 2008 sets out the legislative framework for the NSIP consenting process.
