Responsibility for the terms and administration of the Scheme sits with Motability Foundation and its Board of Governors. Department officials and Motability meet regularly to review the Scheme and how it operates to ensure it meets the needs of disabled people
Motability have announced that from 1 July 2026, customers who need significantly more travel than the standard mileage allowance for essential healthcare, education or employment journeys may be eligible for additional mileage support. Customers must demonstrate they require more than 3,000 miles a year for these purposes, with support applied to approved miles above that threshold through reduced excess mileage charges, while leisure and holiday travel is excluded. Support can be requested when ordering a vehicle or during a lease, with eligibility assessed based on individual circumstances and supporting evidence.

The Approved Mileage Allowance Payment rate is the amount that an employer can reimburse tax-free when an employee uses a private vehicle for business mileage. From 6 April 2026, the rate for cars and vans increased to 55 pence per mile for the first 10,000 business miles. However, this is an advisory rate, and employers may reimburse more or less.
The Ministry of Defence sets its Motor Mileage Allowance rates separately, taking account of the costs associated with authorised duty travel and the need to secure value for money for the taxpayer. Publicly funded transport, including green or white fleet vehicles, is provided where appropriate for authorised duty journeys away from a Service person’s permanent duty station, and Service personnel are not compelled to use their private vehicle for such journeys.
Where an individual receives less than the approved HMRC rate for qualifying business mileage, they may claim Mileage Allowance Relief from HMRC on the difference, subject to HMRC rules. Motor Mileage Allowance rates are kept under constant review.

This Government recognises the vital work of legal aid mental health providers in supporting vulnerable people to access justice.
For civil contracts, including Mental Health, the LAA commissions legal aid services across geographic areas called procurement areas. The Legal Aid Agency (LAA) monitors the numbers of providers holding contracts across England and Wales within different categories of law. All procurement areas in the Mental Health category exceed the minimum number of contracts per procurement area. Information about the number of legal aid contract holders is published as part of the LAA’s Official Statistics: Legal aid statistics quarterly: October to December 2025 - GOV.UK [Tables 9.1-9.8].

The LAA will continue to monitor coverage as we approach the implementation of changes that will impact the Mental Health Tribunal as a result of the Mental Health Act 2025. Details regarding additional demand resulting from the Mental Health Act 2025 are set out in the Impact Assessment published alongside the Act (https://bills.parliament.uk/publications/56782/documents/5311).
In preparation for a new standard civil contract in 2028, the LAA will engage with stakeholders including the Mental Health Lawyers Association to gather views on how best to support the sustainability of the market. These insights will inform LAA’s approach and help shape future contracts to reduce administrative burdens and increase flexibility in the way services are delivered.
The Government is making significant investments in legal aid. We have secured additional funding of over £200 million over the Spending Review period for legal aid transformation, recovery from the cyber-attack, and for moving our legacy systems to a modern and secure technology platform. The transformation programme aims to support sustainability for all providers – including those undertaking mental health legal aid work – by ensuring new digital systems streamline processes and reduce administrative burdens.
Travel payments form part of the wider legal aid remuneration system, which is kept under review. HMRC’s Approved Mileage Allowance Payments sit within the tax framework and do not determine legal aid payment rates. Any changes to legal aid travel payments would be considered on their own merits, taking account of the operation and sustainability of the scheme.

On 8 July Motability announced an exceptions process for those who exceed the new mileage limit for journeys made for healthcare, education and employment. The customer will need to evidence this extra mileage. This exception process is in line with Finance Conduct Authority (FCA) expectations, and any customer can request an exception at any point of the lease lifecycle. More information and how to apply can be found on the Motability website.
The Motability Scheme is operated independently of Government. Decisions about eligibility, lease terms, mileage allowances and support arrangements are matters for Motability. The Government's role is to provide qualifying disability benefits that customers may choose to use to access the Scheme.

Approved Mileage Allowance Payments (AMAPs) are used by employers to reimburse an employee's expenses for business mileage in their private vehicle tax free.
In March, the Government announced a review of approved mileage rates, recognising that motoring costs have evolved significantly in recent years. This review will include consideration of the mileage rate for motorcycles.
As a targeted response to pressures facing drivers as a result of the Iran war, in May 2026, the Government announced an increase to the AMAPs rate for cars and vans to 55 pence per mile for the first 10,000 business miles from 6 April 2026 for tax year 2026/2027. This does not include the rate for motorcycles, which remains at 24p.
Wider questions on the mileage system will be considered at the Budget. More broadly, the Government annually reviews the rates and thresholds of taxes and reliefs to ensure that they are appropriate and reflect the current state of the economy.
