​The Government has made no such assessment. Due to uncertainty around the cost and the industrial processes to reduce cadmium content, it would be difficult to assess how the proposed limits on the concentration of cadmium in fertiliser will affect North and West African phosphate rock miners, and therefore also unclear to what extent UK and wider European industry will switch to Russian or other sources.

Defra does not hold the information requested.
The rate at which cadmium levels in soil change is measured in decades, and to calculate the contribution to soil cadmium levels of (a) phosphate-based fertilisers and (b) environmental pollution would require historical data on cadmium input rates that have not been collected. In particular, the cadmium concentration of phosphate-based fertilisers is not regulated in the UK, and Defra does not collect data on it.
However, Defra does have a recent estimate of the current average rate of input of cadmium into European soils through various mechanisms. For (a) phosphate-based fertilisers this is 0.8 grams of cadmium per hectare per year; and for (b) environmental pollution this is 0.35 grams of cadmium per hectare per year. This estimate is part of the evidence base for an EU fertiliser regulation proposed in March, which limits the concentration of cadmium allowed in phosphate-based EC fertilisers.

The Food Standards Agency does not consider that general consumer advice on cadmium in food is necessary at this time. However the Food Standards Agency supports proportionate measures to reduce inputs of cadmium into the environment and to mitigate cadmium levels in food in order to reduce consumer exposure to this environmental contaminant to as low as is reasonably practicable.

Defra officials have involved UK farmers, fertiliser manufacturers, and sedimentary phosphate rock exporters on the proposal to set limits on the cadmium content of EC fertilisers. The process of removing cadmium from phosphate rock on an industrial scale is still in development and therefore the precise impact on phosphate costs is not yet known.

The Secretary of State has not directly discussed the proposal with her EU counterparts, the Commission, or sedimentary phosphate exporters. Defra officials continue to represent UK interests at Council working group with the Commission on the negotiations for the draft regulation first proposed in March 2016. Defra has involved a range of stakeholders including representatives of sedimentary phosphate exporters. A Council First Reading position is expected to be voted upon by Ministers at a Competitiveness Council in early 2017.

Maximum levels (MLs) for chocolate and cocoa products are in the final stage of being established in food safety legislation. The European Commission has proposed amending Commission Regulation (EC) No. 1881/2006 to set MLs for cadmium in dark chocolate, milk chocolate and cocoa powder, with a five year transition period. The MLs will apply from 1 January 2019.
Where MLs are not set for a foodstuff, the commodity must still comply with article 14 of Commission Regulation No. 178/2002 requiring that food shall not be placed on the market if it is unsafe. Therefore, enforcement action may still be taken on the basis of a risk assessment carried out by the Food Standards Agency, as a result of official control sampling and testing. Cocoa products imported into the United Kingdom are subject to such official controls.
