Parliament complies with the Wildlife and Countryside Act 1981, working through the Schedule 1 licence holder for peregrine falcons in close liaison with Natural England to ensure adherence to legal requirements relating to breeding and disturbance. The licence holder also works with those undertaking building activity across the Parliamentary Estate.
All works have been reviewed by the licence holder and Natural England and, where required, mitigation measures have been implemented to prevent disturbance.

Bird of prey persecution is a national wildlife crime priority and there are strong penalties in place for offences committed against them. Restrictions on the commercial use or trade of birds of prey are in place under the UK Wildlife Trade Regulations. Where any wild falcon is taken and traded illegally the full force of the law should apply to proven perpetrators of the crime.
Defra is a principal funder of the National Wildlife Crime Unit (NWCU), which helps prevent and detect wildlife crime by obtaining and disseminating intelligence, undertaking analysis which highlights local or national threats and directly assisting law enforcers in their investigations. It has played a key role in securing the convictions of criminals found to have been illegally taking peregrine falcon eggs and chicks from the wild. Defra is providing 494,000 for the NWCU in 2025-2026.
Defra also provides funding to Science and Advice for Scottish Agriculture to develop DNA forensic analysis for the police and other organisations investigating crimes against peregrine falcons. DNA profiling of peregrines is a critical element in deterring wild take and illegal export, and convicting criminals.

Defra has not made any assessment of the impact of peregrine falcon egg theft on the peregrine population.
The Government does, however, take all wildlife crime seriously, including the theft of wild bird eggs, which is an offence under the Wildlife and Countryside Act 1981.
In 2022 Defra more than doubled its funding of the National Wildlife Crime Unit from a total of ÂŁ495,000 over the three previous years to ÂŁ1.2 million for the three-year period of 2022-25 to target wildlife crime priorities, in particular crimes against birds of prey, which is a national wildlife crime priority.
Defra supports the work of the Bird of Prey Crime Priority Delivery Group, and that of the CITES Priority Delivery Groups, which bring together police, government and stakeholders from conservation organisations to tackle this type of persecution. In addition, we are providing funding to Science and Advice for Scottish Agriculture (SASA) to develop DNA forensic analysis for the police and other organisations investigating crimes against peregrine falcons.
Additionally, the UK is an active member of the Intergovernmental Task Force on the Illegal Killing, Taking and Trade of Migratory Birds in the Mediterranean (MIKT). The MIKT facilitates international cooperation to tackle bird crime, including the illegal persecution and taking of raptors.

The Department for Environment, Food and Rural Affairs (Defra) and the Animal and Plant Health Agency (APHA) are continuing to develop an electronic permitting (e-permitting) system through which traders and individuals would be able to apply for CITES permits and certificates online. The system would be accessible for all CITES listed specimens including live falcons.
Timelines for progressing this work are currently subject to further discussion however we remain committed to delivering an efficient and modern domestic regime.

On 1 June 2020, the Export Health Certificates (EHC) Online service was made available by Defra and the Animal and Plant Health Agency. This service allows exporters to apply for certain EHCs using a fully online application process.
The EHCs to export captive birds (live falcons) to the United Arab Emirates and Japan were released on the EHC online service on 1 June 2020, replacing the paper-based application process.
A further 13 EHCs for the export of captive birds to various countries will be available for use via the online service by the end of 2020.

The merlin is protected by the Wildlife and Countryside Act 1981 which makes it an offence to take, kill or injure any wild bird; take or damage their nests while in use; and take or destroy an egg. This robust legal framework protects the merlin from persecution, with penalties including imprisonment.
The Department has not made an assessment of merlin population levels. A study by Ewing et al reported that in 2008 there were approximately 1,100 breeding pairs of merlins in the UK.
Several measures are in place to protect habitats. The UK has designated 615 sites as Special Areas of Conservation under the Habitats Directive, and 270 sites as Special Protection Areas under the Birds Directive to provide protection to our most vulnerable and threatened wild birds.
The Government has also provided ÂŁ7.5 million to establish twelve Nature Improvement Areas. These are intended to benefit birds by improving existing habitat, creating new habitat and improving connectivity between habitats.
