All model policies provided by the Cabinet Office for departmental use are kept under continuous review. Any review of the model Gender Identity and Intersex Policy will be impacted by factors such as the Supreme Court Ruling in the For Women Scotland case.

Trans and intersex people deserve dignity and respect. Protections remain in place for them to live free from discrimination and harassment.
Regarding service provision, we want everyone to be able to access services that meet their needs whilst protecting their privacy and safety. The EHRC’s updated Code of Practice will provide guidance to providers, and we are considering their draft.

The EHRC has opened its consultation on the draft updated statutory Code of Practice for Services, Public Functions and Associations, seeking views from affected stakeholders. We encourage people to ensure their views are heard by submitting a response to the consultation by Monday 30th June. We will consider the final draft Code once it has been submitted and engage with the EHRC to ensure it provides the further certainty and clarity service providers need, in line with the ruling.

The Government understands people with those conditions to have Variations in Sex Characteristics, but we do not hold central definitions of the biological sex of people who have these conditions, nor do we keep any records.

The Government has set out our expectation that organisations follow the clarity the ruling provides. The EHRC’s interim update provides a perspective on how the judgment and Equality Act are practically applied in some areas. The EHRC has already committed to supporting service providers with its updated statutory Code of Practice following consultation; we will engage them as necessary as they progress this work.

The Equality and Human Rights Commission (EHRC) is independent of government. It is for the EHRC to ensure that the consultation process is appropriate and meaningfully engages with varied stakeholders.

The UK recognises the fundamental importance of protecting the human rights of all people, including those with variations in sex characteristics (VSC), and we await the OHCHR report on the human rights of intersex people.
It is important to understand the experiences of people living with VSC in the UK and to use this insight to shape policy. In this vein, the Government is currently monitoring and considering evidence and research specific to people living with VSC.
