To ask the Secretary of State for Foreign, Commonwealth and Development Affairs, if he will take steps to prevent JCB equipment being used by the Israeli Government in the Occupied Palestinian Territories.
The UK Government has a clear position that Israeli settlements in the Occupied Palestinian Territories are illegal under international law. We have guidance on gov.uk that states there are clear risks related to economic and financial activities in the settlements, and we do not encourage or offer support to such activity. UK citizens and businesses should be aware of the potential reputational implications of involvement in economic and financial activities in settlements, as well as possible abuses of the rights of individuals that such activity may entail. Those contemplating any economic or financial involvement in settlements should seek appropriate legal advice.
The Government also supports voluntary due diligence approaches taken by UK businesses to identify and prevent human rights abuses, in line with the UN Guiding Principles on Business and Human Rights (UNGPs) and the Organisation for Economic Co-operation and Development Guidelines for Multinational Enterprises.

To ask the Deputy Foreign Secretary, what steps his Department is taking to ensure compliance with sanctions against Russia by (a) JCB and (b) other companies.
Non-compliance with UK sanctions is a serious offence that can result in prosecution. Departments and agencies from across His Majesty's Government are working together to support business compliance through the provision of detailed published guidance for exporters and financial institutions, including on circumvention red flags. We have been clear to UK business that they need to satisfy themselves that their goods will not end up in Russia in breach of sanctions, and must undertake robust due diligence. His Majesty's Revenue & Customs leads on the enforcement of trade sanctions at the border.

The UK National Contact Point (UK NCP) operates independently of the Department for International Trade. In line with its Rules of Procedures and the Final Statement published in November 2021, the UK NCP will request an update from JCB on the implementation of its recommendations in November 2022, which is one year from the date of the publication of its report. The UK NCP will then issue a follow up statement which will also be published on gov.uk.
To ask Her Majesty's Government what assessment they have made of the finding by UK National Contact Point that JCB was in breach of Organisation for Economic Cooperation and Development guidelines for Multinational Enterprises; and what steps they are taking to ensure that UK companies adhere to those guidelines.
To ask Her Majesty's Government what assessment they have made of the finding by UK National Contact Point that JCB was in breach of Organisation for Economic Cooperation and Development guidelines for Multinational Enterprises; and what steps they are taking to ensure that UK companies adhere to those guidelines.
The UK National Contact Point (UK NCP), which operates independently of the Department for International Trade, has not found that JCB violated human rights. However, in line with the OECD Guidelines, the UK NCP has advised JCB to develop a policy commitment to respect human rights and to carry out human rights due diligence in supply chains.
The UK NCP will request an update from JCB on the implementation of its recommendations in a year’s time and in the interim is available to provide support as necessary.
As part of its commitment to the OECD Guidelines, the UK NCP promotes the Guidelines to business, NGOs and trade unions, and is available to provide advice on adhering to the recommendations it contains.
Is it not the case that the most exciting industrial development in the UK at present is hydrogen production? Does the Secretary of State welcome the pioneering work by JCB, under Lord Bamford’s direction, along with the partnership with Queen’s University Belfast, to produce the first working hydrogen combustion engine, which has made the past the future? What support will the Secretary of State give to capitalise on that engineering excellence to ensure that British jobs and British tech flow from it?

Where JCB equipment is subject to export controls the exporter must have a licence authorising shipment. All export licence applications are assessed rigorously against the Consolidated EU and National Arms Export Licensing Criteria. The Consolidated Criteria provide a thorough risk assessment framework and require us to consider the impact of providing equipment and its capabilities. The Government will not grant a licence if to do so would be inconsistent with these criteria, including respect for human rights and international humanitarian law.
The British Government is fully committed to the promotion of the UN Guiding Principles on Business and Human Rights, and the Organisation for Economic Cooperation and Development Guidelines for Multinational Enterprises. The UK government has had discussions with JCB on a range of subjects and continues to encourage and foster respect for human rights among UK businesses.

The Foreign and Commonwealth Office has online advice to raise awareness of the key security and political risks which UK businesses may face when operating abroad, including in Israel and the Occupied Palestinian Territories (OPTs). This includes guidance on Israeli settlements. We are advising British businesses to bear in mind the Government's view on the illegality of settlements under international law when considering their investments and activities in the region. This is voluntary guidance to British businesses on doing business in Israel and OPTs. Ultimately it will be the decision of an individual or company whether to operate in settlements in the Occupied Territories, but the Government would neither encourage nor offer support to such activity.
