Written question asked by Lord Avebury (Liberal Democrat), in the House of Lords. It was answered by Baroness Wilcox (Conservative) on Tuesday, 26 October 2010.

Equality Act 2010

Question
To ask Her Majesty’s Government whether they will seek legal advice about which matters complained of in the European Commission’s Reasoned Opinion 226, infringement number 2006/2450, remain in potential breach of EU directives following the enactment of the Equality Act 2010.
Answer

There is an understanding that infringement proceedings are a confidential matter between the European Commission and member states. It would therefore be inappropriate to comment on this particular reasoned opinion. As a matter of routine, my department is able to draw on legal advice as and when necessary.
