Question: To ask the Parliamentary Secretary, Department for Constitutional Affairs, what advice is issued to asylum adjudicators regarding the grounds for granting refugee status to applicants who have fled persecution because of their homosexuality.

Answer: Mrs. Roche: To ask the Parliamentary Secretary, Department for Constitutional Affairs what advice is issued to asylum adjudicators regarding the grounds for granting refugee status to applicants who have fled persecution because of their homosexuality. [210707] Mr. Leslie: Immigration Adjudicators are independent members of the judiciary, and as such no specific advice or guidance is issued in relation to claims based on an appellant's sexuality. Immigration Adjudicators will determine each asylum appeal based on their own findings of fact and by applying the law as established to that particular claim.
