Proceeding contribution from Lord Rooker (Labour) in the House of Lords on Monday, 4 July 2005. It occurred during Debates on delegated legislation on Criminal Justice (Northern Ireland) Order 2005.
Criminal Justice (Northern Ireland) Order 2005
I have an answer. The provisions are nothing to do with homosexual offences. They prohibit sex in public. The issues relate—I can remember the debates—to people challenging others for having sex in the back garden, on the lawn or in the swimming pool. The order prohibits that in public places, not only toilets. It does not mean only sex between same-sex couples, but heterosexual sex as well. The order does not cover the issue raised by the noble Lord, Lord Maginnis, but covers the wider area dealt with by the previous legislation. So no sex in the back garden, I am afraid.
