My Lords, I do not have an answer to the point made by the noble Lord, Lord Phillips. It is certainly a reasonable question. I await advice. It seems to me quite reasonable that people should be put on notice. In response to the question asked by the noble Lord, Lord Hodgson, the reason for the amendment being in the terms in which it is is simply because it has the effect of reducing the costs. The purpose is to ensure that the attorney and the commission do not simply duplicate work and that the commission does not inadvertently act without the attorney’s knowledge. It is simply to ensure that there is a common understanding behind the approach that is being adopted. On Question, amendment agreed to.
