I am grateful to the noble Duke for his comments. The question of whether the use of land is for agricultural purposes is important in deciding whether rights of common go with the dominant tenement. There will not be an answer in every single case, which is why we ask for the Secretary of State to make regulations to provide what is and is not to be regarded as the use of land for agricultural purposes. I am advised that our amendment has nothing to do with Amendment No. 44, but what we feel may be unlikely to be eligible as non-agricultural use are potentially horse grazing, storing materials or land that is derelict.
