moved Amendment No. 82:"Page 6, line 13, leave out subsection (2)." The noble Lord said: In this amendment I seek to delete Clause 9(2), which concerns the examination of cases. The subsection states that the commissioner’s powers do not extend,"““to a field in which the Assembly does not have functions””," or, in the case of paragraph (b),"““to give assistance in a case relating to a service which . . . is proposed to be, or has failed to be, provided outside Wales””." Clearly, I fully recognise that we are debating the non-devolved situation. I have made my points on that, as has the Minister, but I need to propose this amendment. I beg to move.
