Perhaps I can explain a bit further. We must have flexibility in the remedies and I agree that there will be circumstances in which instructing another lawyer to take on the work would be better, for all sorts of reasons. The question is: who engages that other lawyer and who is responsible? The difficulty is that if the OLC engages the other lawyer, it has responsibility for what then happens, which takes it into a different role. I want to avoid that. The flexibility to enable other lawyers to participate is right and proper, but that is in the legislation. I am not spurning the proposal; I am merely saying that the OLC should not have that responsibility itself.
