My Lords, perhaps I may help the House, because the amendment states: "““Before appointing an ordinary member, the Lord Chancellor must consult the Lord Chief Justice””." That is in Schedule 1, which states: "““In this Schedule a reference to an ‘ordinary member’ is a reference to a member of the Board other than the Chief Executive””." It would therefore cover the chair.
