6: After Clause 2, insert the following new Clause— ““The Secretary of State’s duty as to the NHS Constitution After section 1A of the National Health Service Act 2006 insert— ““1AA Duty as to NHS Constitution ““(1) In exercising functions in relation to the health service, the Secretary of State must have regard to the NHS Constitution. (2) In this Act, ““NHS Constitution”” has the same meaning as in Chapter 1 of Part 1 of the Health Act 2009 (see section 1 of that Act).””””
