As the hon. Lady very well knows, Labour is the party of devolution. We are the only party that has delivered any extra powers for Wales, and I, as Secretary of State, am proud that I legislated in the 2006 Act for the option of a referendum to deliver full law-making powers for the Welsh Assembly Government, and in time I am sure that that will come about. Specifically, as she has asked, work is continuing among my officials in response to the First Minister's request under the 2006 Act to take this process forward, so that a referendum can be called as and when it is required.

On his own website, the Secretary of State says that it is "clear" to him""that a referendum held before or in 2011 would be lost","
and that further powers should not be granted""today…tomorrow, nor even next year or the year after that"."
Given these comments, will he be accepting the referendum request currently sitting on his desk, or, like so many of his colleagues, will he be waiting for any decisions to be taken by an incoming Conservative Government?

There has been no pressure—certainly from the Government side—to introduce tax-varying powers for the Welsh Assembly Government. As my hon. Friend has said, they have not been used in Scotland to date.

I understand the passion with which the hon. Gentleman asks the question. The issue that Ministers have had to grapple with is balancing the right and desire of Welsh speakers to have bilingual juries with ensuring at the same time that random selection is maintained. This is part of a continuing dialogue as we move into the future.

I congratulate my hon. Friend on the work of the Welsh Affairs Committee in taking forward record levels of scrutiny and speeding this process through. It is our Government's determination that all the legislative competence orders that have been effectively scrutinised by his Committee will get Royal Assent. There is a Statutory Instrument Committee next week, and I hope that the hon. Member for Chesham and Amersham (Mrs. Gillan) will co-operate in speeding those through. Yes, in the wash-up negotiations, I hope that the Opposition will back the Welsh Assembly Government's policy and the LCO to deliver policies to tackle lack of housing and homelessness in Wales, which they are threatening to block.

Powers are transferred to the National Assembly for Wales via framework powers in UK Acts of Parliament and through Orders in Council (Legislative Competence Orders).Three Bills currently before Parliament include framework powers—the Constitutional Reform and Governance Bill, the Marine and Coastal Access Bill and the Local Democracy, Economic Development and Construction Bill.One draft Legislative Competence Order (LCO), on the Welsh Language, is currently before Parliament for approval. Four proposed LCOs are currently subject to pre-legislative scrutiny in Parliament. These cover domestic fire sprinklers, culture, local government and school governance. A further two proposed LCOs, on the environment and mental health, have recently completed pre-legislative scrutiny.

The devolution settlement put in place by the Government of Wales Act 2006 is working well. I ensure that the processes for transferring powers to the National Assembly for Wales are subject to continuous review and improvement.Under the settlement, powers are transferred to the National Assembly via framework powers in Acts of Parliament and through Orders in Council (Legislative Competence Orders). Powers have been transferred in a total of 45 different areas to date, in seven Acts of Parliament and four Legislative Competence Orders. Following the Government of Wales Act 2006, the Wales Office officials and lawyers continue to work with Cabinet Office, Ministry of Justice and other territorial Offices to deliver a programme of seminars across UK Government Departments. These seminars are designed to promote devolution awareness and understanding of the settlements across the UK Government.

As the hon. Gentleman knows—I think that he was present for it—there was a briefing on the Planning Bill given by my hon. Friend the Under-Secretary of State for Wales and the Minister concerned last week. At that briefing, it was explained why the complexities involved meant that the framework clause was not yet ready. When it is ready, the hon. Gentleman will be given an opportunity, as will his hon. Friends and all other Members who have an interest, to question the Ministers concerned. The measure will be subject to proper scrutiny, as it will be throughout the process as it goes into the Bill and is debated in the House.

Last year, the Welsh Assembly Government applied to the Wales Office for framework powers conferring legislative competence to be included in the Planning Bill. Six months later, the Bill has had its Second Reading and is now in Committee, yet the draft clauses relating to those powers have still not been produced. Will the Secretary of State please tell us whether that unacceptable delay is the product of deliberate policy, administrative oversight or simple incompetence?

Parliament is the proper source for granting extra powers and passing the legislation so to do. The powers that are now being exercised through Orders in Council and the framework powers being established in primary legislation are within the terms of the settlement endorsed by the people of Wales in a referendum in 1997, which the hon. Gentleman's party opposed.

I thank the Secretary of State for his reply, but does he accept that there has been no consultation among the people of Wales on the new powers for the Assembly? Why will he not allow the people of Wales to choose, in a referendum, whether they want the Assembly to have those powers?
