It is only possible to say that a premise is compliant at the time of the inspection. The FP(WP) regulations place a duty on the responsible person to review the risk assessment whenever there is a change in conditions. Mr. Jim Cunningham: To ask the Secretary of State for the Home Department what measures are in place to ensure that animal experiments taking place at universities are legal and ethical. [179599] Caroline Flint :[holding answer 22 June 2004]: The use of animals in scientific procedures in the UK, whether at universities or elsewhere, is strictly regulated by the Home Office in accordance with the Animals (Scientific Procedures) Act 1986. Licences are only granted for animal experiments undertaken for specified permissible purposes. There has to be no alternative to using animals, and the likely benefits of the work have to outweigh the adverse effects on the animals concerned. The number of animals used and any suffering that may be caused have to be minimised. Any proposal to conduct a programme of animal experiments has first to be considered by the local ethical review process at the establishment concerned. A licence application is only submitted to the Home Office once those involved in that local process are satisfied that it can be justified. Applications received by the Home Office are rigorously assessed by the Animals (Scientific Procedures) Inspectorate, to ensure the criteria in the 1986 Act are met. Inspectors are either medical or veterinary graduates, and advise the Secretary of State on whether and on what terms licence authorities should be granted. Some applications are also referred for advice to the Animal Procedures Committee. Establishments where licensed animal experiments are conducted are visited regularly by the inspectorate, to monitor progress and ensure compliance with licence authorities. The majority of visits of inspections are without notice. Appropriate action is taken should irregularities or breaches of licence conditions come to light.

[176671] Paul Goggins: The current Home Secretary has not visited Durham prison, however, as Minister for Correctional Services, I visited on 19 March 2004. Her Majesty's Chief Inspector of Prisons last inspected Durham male prison between 19 and 22 August 2003 and the female prison between 5 and 9 January 2004. Mike Newell, has been the governing governor of Durham prison since May 1999, prior to that he was governor of Hull prison between March 1996 and May 1999. Since January 1997 there have been no escapes or absconds from Durham. Data show that each prisoner had an average of 18 hours purposeful activity each week. Mr. Hancock: To ask the Secretary of State for the Home Department pursuant to his Answer of 20 January 2004, Official Report, column 1205W, on animal welfare, ref 147328, with reference to recommendation 14, when the Inspectorate will be reviewed; and by whom. [155934] Caroline Flint: In its report, published in July 2002, the House of Lords Select Committee on Animals in Scientific Procedures recommended that the Home Office Animals (Scientific Procedures) Inspectorate should be subject to periodic review, by a body other than the Inspectorate itself. The Committee went on to describe the Inspectorate as a "trustworthy, professional body" and also acknowledged the valuable role that it has played in creating a culture of care in establishments licensed under the Animals (Scientific Procedures) Act 1986. In the Government's response, published in January 2003, we welcomed the Select Committee's endorsement of the integrity of the Inspectorate and of the important contribution that it has made to the welfare of animals in designated establishments. However, we recognise that public awareness of the valuable job done by the Inspectorate is poor and agree that this needs to be remedied. We have, therefore, concluded that there would be value in the Inspectorate publishing an annual report on its work. The Inspectorate's first annual report will be published in the autumn of 2004. As to the periodic review of the Inspectorate, under Section 18 of the 1986 Act, Inspectors are responsible directly to the Secretary of State who is, in turn accountable to Parliament for their work. Inspectors are all medical or veterinary practitioners, as well as being civil servants, and are bound by medical or veterinary codes of professional conduct. In addition, in common with other Home Office staff, the Chief Inspector and members of the Inspectorate are subject to the civil service code and annual performance reviews as part of routine personnel management arrangements. In the light of these comprehensive arrangements, we do not believe that any further form of performance review is necessary. Members of the Inspectorate are highly professional and dedicated and have the complete confidence of Government Ministers.

Chris Ruane: To ask the Secretary of State for the Home Department if he will list the (a) police authorities and (b) local authorities that have not incorporated section 17 of the Crime and Disorder Act 1998; and what measures are open to members of the public if they feel that their local police authority or local authority is failing to implement section 17. [154302] Ms Blears: Information is not available centrally on local/police authorities that have failed to incorporate section 17 of the Crime and Disorder Act 1998. However, the Audit Commission looks at how well local councils deliver their services under the Comprehensive Performance Assessment (CPA). Inspections of English district councils, include community safety with a specific focus on section 17 compliance. From 2005 Safer and Stronger Communities with a similar focus on section 17 compliance will form part of the CPA for all top tier councils where it will be covered under the councils' Corporate Assessment. Members of the public could lobby their elected council member (or MP) or appropriate chair of the Crime and Disorder Reduction Partnership or the chair of the Police Authority if they believe their local authority or local police authority was failing to implement section 17. They could also approach the Local Government Ombudsman if they have a specific complaint of maladministration. They could ultimately undertake a judicial review action with a view to enforcing local/police authority compliance with section 17.
