The UK abstained on the UN General Assembly resolution seeking an advisory opinion from the International Court of Justice (ICJ) on the legality of Kosovo's declaration of independence. We strongly support the Court, but believe that Serbia's primary motivation for the question was political and that the resolution was pushed through with insufficient debate on its substance.The UK has participated actively in the Court's proceedings, making two written submissions and an oral statement.The UK explained to the Court that the declaration of independence was not incompatible with either general international law or UN Security Council Resolution (UNSCR) 1244. UNSCR 1244 set a framework for status negotiations; it did not predestine any particular outcome. The negotiating process was pursued with commitment by many, including the international community. However, these exhaustive attempts to achieve an agreed resolution ultimately failed. This led the UN Special Envoy for the Future Status Process for Kosovo to conclude that independence was the only viable solution.A number of very particular factual circumstances, including the violent break-up of Yugoslavia, serious human rights abuses against Kosovo Albanians by Serbia, and the sustained involvement of the international community in the attempt to achieve a resolution make Kosovo a sui generis case which creates no wider precedent for developments elsewhere.To date, 64 countries have recognised Kosovo and it is now a member of the International Monetary Fund and World Bank. The Foreign and Commonwealth Office (FCO)'s budget for its activities in Kosovo comprises (a) operational costs for our embassy in Pristina and (b) discretionary programme funding. In addition, the Conflict Prevention Pool and Peacekeeping Budget (separate budgets owned jointly by the FCO, Ministry of Defence and Department for International Development (DFID), with decisions on spending taken tri-departmentally, irrespective of the implementing Department) fund a range of Kosovo related activity.Below is a breakdown for financial years (FY) 2008-09 and 2009-10:

Activities funded by the tri-departmental conflict funding are:"(a) discretionary spending in support of military and civilian peacekeeping missions.""(b) conflict related programme expenditure."The reduction in conflict funding between FY 2008-09 and FY 2009-10 relates principally to the decision in March 2009 by the North Atlantic Treaty Organisation (NATO) Supreme Allied Commander for Europe that the capacity provided by British troops to the NATO force in Kosovo (KFOR) could be reduced given the steady improvement of the security environment in Kosovo.In addition to these figures, the FCO—on behalf of the three departments—pays the UK's assessed contributions for the Organisation for Security and Cooperation in Europe (OSCE) Mission in Kosovo, the EU Rule of Law Mission in Kosovo (EULEX) and the UN Mission in Kosovo (UNMIK). We contribute 11.09 per cent. of the OSCE overall budget for field missions, equating to €3,333,687 in 2008 and €2,984,319 in 2009. The UK pays approximately 17 per cent. of the common costs of all European Security and Defence Policy missions, including EULEX. For the period from August 2009 to June 2010, the approximate UK contribution to the common costs of EULEX is £22 million. The UK contribution to common costs for UNMIK in 2008-09 were £7,508,472 and are projected to be £3,155,032 in 2009-10.Decisions have not yet been made on embassy operational, FCO discretionary programme or Conflict Prevention Pool allocations for 2010-11 nor have all the relevant multilateral negotiations on mission budgets taken place.This does not represent the total Government budget in Kosovo. For example, DFID spent £3.1 million in Kosovo in the financial year 2008-09 and funded the UK's share of assessed costs for UN agencies, the World Bank and European Commission's Instrument for Pre-Accession.

The Foreign and Commonwealth Office's (FCO) budget for expenditure is £1.1 million on embassy staff and other operational costs and around £200,000 on support for the British Council in the 2008-09 financial year. Technical assistance to the Kosovo government is provided through a combination of FCO bilateral funding, project activities under the joint FCO/Department for International Development/Ministry of Defence Conflict Prevention Pool and the FCO's Strategic Programme Fund. The total budgets for expenditure for these three funds in the 2008-09 financial year are: £76,000; up to £3.8 million; and £110,000 respectively. Our work with non-governmental organisations in Kosovo is also funded from the Conflict Prevention Pool and the Strategic Programme Fund. The FCO does not provide budgetary support for the government of Kosovo and non-governmental bodies working in Kosovo.The UN Mission in Kosovo's approved budget for the 2008-09 financial year is US$198 million, of which the UK's contribution is 7.9 per cent. or US$14.8 million (around £7.4 million). The EU Rule of Law Mission in Kosovo's (EULEX) approved commitment appropriation for calendar year 2008 is €140 million, of which the UK's contribution is 17 per cent. or €23.8 million (around £18.9 million). The actual amount spent on EULEX in 2008-09 will not be known until the end of the financial year. The Organisation for Security and Co-operation in Europe Mission in Kosovo's (OMIK) approved budget for calendar year 2008 is just over €30 million, of which the UK's contribution is 11.09 per cent. or €3.3 million (around £2.6 million). The budget for calendar year 2009 is yet to be approved but in UK financial year 2007-08, the UK contribution to OMIK was €3.7 million. We would not expect this level to be exceeded in 2008-09.We have provisionally budgeted for a total of 76 UK secondees to EULEX in 2008-09 at an estimated cost of £5.3 million and for a total of five UK secondees to the International Civilian Organisation at an estimated cost of £377,000. We have one UK secondee to OMIK at a cost of around £70,000 per annum.

As of July 2008,46 UK police officers were serving with the UN Mission in Kosovo (UNMIK). 24 contracted UK staff members were serving with UNMTK and performing the following roles:"2 international prosecutors;""senior legal officer;""legal officer;""court recorder;""Head of the Penal Management Division;""senior Civil Affairs officer;""2 Civil Affairs officers;""Chief telecommunications engineer;""Political Affairs officer;""Operations officer;""Public Information officer;""Outreach officer;""Five security officers;""Interpreter / Translator;""Chief of Administrative Services;""Acting Chief;""Support officer; and""Secretary."27 UK police officers will transfer from UNMIK to the EU Rule of Law Mission in Kosovo (EULEX) where they will be joined by another six officers.
